HomeMy WebLinkAbout~Master - Zoning Board of Adjustment Minutes 3-22-2006 MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT AMES, IOWA MARCH 22, 2006 The Ames Zoning Board of Adjustment met, pursuant to law, in regular session at 7:00 p.m., on March 22, 2006, in the Council Chambers of City Hall with the following members present: Denise Link, Mary Ann Lundy, Lucy Martin, Bradley Miller and Charles Samuels. Staff members Matt Flynn, Ray Anderson, John Joiner, and Judy Parks were also present. APPROVAL OF THE MINUTES: Moved by Martin, seconded by Miller, to approve the Minutes of the February 22, 2006, Zoning Board of Adjustment Meeting. Vote on Motion: 5-0. Motion declared carried. CASE NO. 06-11 SPECIAL USE PERMIT – 401, 405, 407, AND 415 FREEL DRIVE - GEORGE L. JONES, PROPERTY OWNER; DARWIN REIS, APPLICANT; BRAD STUMBO, CONTACT PERSON Public Hearing on Application for Special Use Permit in a zone other than residential or commercial to allow the use of the site at 401, 405, 407, and 415 Freel Drive as a yard waste disposal operation Planner Anderson showed the site plan for the yard waste site that is currently in use. A Special Use Permit was granted for a portion of this site in December of 2002, but the properties at 401 and 415 Freel Drive are now also being used, so a new Special Use Permit is needed to accurately reflect the site. Improvements in terms of parking, landscaping, and fencing are also required: paved parking for the office building; fencing with sliding gates along the paved area; and landscaping outside of the fencing. Staff has reviewed the application and recommends approval with the following stipulations, as the stipulations regarding parking areas and unused utility lines have been resolved: 1) That the applicant implement all the site improvements included on the site plan, including the installation of all fences, gates, landscaping, paved surfaces for parking and drive aisles, including striping for parking spaces and accessible parking, prior to May 31, 2006. 2) That the yard waste material not be stacked any higher than 12 feet from grade. Martin asked if it was reasonable for the site improvements to be made by May 31st. Anderson stated that they believe it is, but if the weather were to be a problem they could ask for an extension. Miller asked why the deadline was in place. Anderson explained that it was to ensure that the improvements are made in a timely manner. The Special Use Permit could be granted by the Board tonight and if the work were not completed by the date given a municipal infraction would be charged. The applicants’ representative, Brad Stumbo of Stumbo and Associates, 510 South 17th Street, stated that he had nothing to add. 2 The applicant, Darwin Reis of 407 Freel Drive, was asked if the site improvements could be made by May 31st. He said that the cost of the paved parking area is a concern, and extending the deadline another month to break the cost up into the cash flow would be helpful. Joyce Jones, the property owner, of 1302 N.E. Trilein, Ankeny, stated that she would like to know how big the paved area is. She thought that an extension of another month to do the paving would be helpful too, because of how big it is and how much it will cost. Miller asked who was paying the cost of the paving and it was explained that is being split between the applicant and property owner. Anderson stated that the paving is about 150' x 40'. Moved by Martin, seconded by Samuels, to approve ORDER NO. 06-11 granting a Special Use Permit in a zone other than residential or commercial to allow the use of the site at 401, 405, 407, and 415 Freel Drive as a yard waste disposal operation with the following stipulations: 1) That the applicant implement all the site improvements included on the site plan, including the installation of all fences, gates, landscaping, paved surfaces for parking and drive aisles, including striping for parking spaces and accessible parking, prior to June 30, 2006. 2) That the yard waste material not be stacked any higher than 12 feet from grade. Vote on Motion: 5-0. Motion carried unanimously. CASE NO. 06-12 SPECIAL USE PERMIT - 309 CARNEGIE AVENUE - CITY OF AMES, PROPERTY OWNER AND APPLICANT Public Hearing on Application for Special Use Permit in a zone other than residential or commercial to allow the use of the site at 309 Carnegie Avenue as a yard waste disposal operation Public Works Director Joiner stated that he is representing the City for this case as both the applicant and property owner. This application is a back-up to the permit the Board just approved for All-Season’s Contracting, as there are two free spring yard waste days on April 22 and April 29. This application is for the City’s west yard at the end of Edison where there is a t-intersection with Carnegie. Traffic would enter from Dayton and go west down Edison. At the intersection of Edison and Carnegie is the entrance to the site. Traffic would be directed to the very northwest corner of the site, where they currently stockpile snow, and then exit back out the same direction onto Dayton Avenue. Samuels asked why this Special Use Permit is being granted only through June 30. Joiner stated that is the end of the fiscal year so this just allows a back-up plan for the two free yard waste days. Flynn explained that the Planning & Zoning 3 Commission was concerned that the City might get into the yard waste collection and recycling business on a permanent basis, so a deadline was given. Rick Ely, 1817 East Lincoln Way, spoke in opposition to this Special Use Permit. He is concerned that if the City opens the site for yard waste even this one time, it will make the public aware of the site. He is concerned that the public will then use the site as a dump, because even now some of his customers throw their junk on the City’s side of the fence, and it would be even harder for him to control the problem if the site were seen as a dump site. Joiner stated that he understands Mr. Ely’s concerns. He said the City also wants to keep the site clean and hopes to control this by having the yard waste dropped off at the far northwest corner of the site. The material would be moved off-site by the following Monday. The site is completely fenced and the entrance at Edison and Carnegie will have a locked gate to keep it from being accessed by the public. Moved by Miller, seconded by Samuels, to approve ORDER NO. 06-12 granting a Special Use Permit in a zone other than residential or commercial to allow the use of the site at 309 Carnegie Avenue as a yard waste disposal operation through June 30, 2006. Vote on Motion: 5-0. Motion carried unanimously.
