the meeting of October 24, 2007.

CASE NO. 07- 29
CONDITIONAL USE PERMIT IN THE GENERAL FLOOD PLAIN (OVERLAY)
DISTRICT – MTD LC, PROPERTY OWNER; MATT CARNEY, APPLICANT, 618
FREEL DRIVE
Public Hearing on application for Conditional Use Permit to allow the construction of a
warehouse addition to the building in the General Flood Plain (Overlay) District on the
property at 618 Freel Drive
CASE NO. 07- 27
SPECIAL USE PERMIT - MTD LC, PROPERTY OWNER; MATT CARNEY,
APPLICANT, 618 FREEL DRIVE
Public Hearing on application to amend a Special Use Permit to allow the construction of a
warehouse addition to the building, additional off-street parking, and other site
improvements for the salvage yard at 618 Freel Drive.
Planner Anderson explained that a 27,600-square-foot addition is being proposed to an existing
19,482-square-foot building on this property. Once completed, 37,749 square feet of the
building will be used as warehouse space and the remaining 9,333 square feet will be used for
vehicle tear-down. Anderson stated that the addition will be constructed of white, corrugated
metal of the same type as is already there. A paved parking lot, with 41parking spaces and a
20-foot-wide drive aisle, is also being proposed. The new entrance to the site will be off SE 5th
Street, rather than Freel Drive, as it presently is. An eight-foot-high, white, corrugated steel
fence already exists along a portion of the west property line on Freel Drive; with the proposed
improvements, the fence will be extended southward, almost all the way to the driveway. A new
fence and landscaping materials will be installed on the north property line along SE Fifth Street
to the new entrance. New steel security fencing will also enclose the east and south sides of the
new parking area.

Anderson explained that the original Special Use Permit for this salvage yard was approved in
1984; it was amended in 1997 with several stipulations. Staff has reviewed the standards with
respect to this new proposal and believe they are met. He recommended approval of this
amendment to the permit, with several stipulations that are similar to those previously imposed.
The Conditional Use Permit, Anderson explained, is to allow this addition to be constructed in
the Skunk River floodway fringe. He stated that the owners are proposing to build the structure
three feet above the 100-year flood elevation, in accordance with the City code. Staff
recommended that the permit be granted with a stipulation that all items that are potentially
injurious to plant or animal life must also be stored at least three feet above the base flood level.
Board Chair Miller asked if the new paved parking lot would affect storm water management
requirements. Anderson stated that the City’s engineering staff reviewed the information and
determined that the regional storm water detention pond in the southeast corner of Parcel E will
suffice.
Matt Carney, 2108 Buchanan Drive, stated that he owns the property at 618 Freel Drive and
indicated that he had no objections to the stipulations proposed by staff.
Moved by Link, seconded by Miller, to ADOPT ORDER 07-29 granting a Conditional Use
Permit to allow the construction of a 27,600-square-foot addition to the existing building,
and the addition of forty-one (41) new paved parking spaces, and other site improvements in
the Floodway Fringe District, with the stipulation that materials and equipment that are
flammable, explosive, or injurious to human, animal or plant life will be stored at least three
(3) feet above base flood elevation.
Roll Call Vote: 5-0 Motion declared approved unanimously.
Moved by Miller, seconded by Martin, to ADOPT ORDER 07-27, granting an amendment
to the previously-approved Special Use Permit for an auto salvage yard on the property at
618 Freel Drive to allow the construction of a warehouse addition to the existing building,
additional off-street parking, and other site improvements for the salvage operation, with the
following stipulations:
1. that the salvage yard be fenced in the locations shown on the site plan with a solid,
opaque, eight-foot (8') fence, similar in design to the existing fence used to screen the
existing operation along the north, south, east and west property lines;
2. that no salvage material be visible above the top of the fence;
3. that the fencing of the property be completed prior to occupancy of the warehouse
addition;
4. that dust abatement measures be undertaken on the internal gravel drives when needed;
5. that the fence, driveway, parking areas and internal roadways be maintained – this
maintenance shall include replacement or repair of the fence within 14 days if it is
damaged or comes down, as well as replacement or repair whenever peeling or chipping
occurs;
3
6. that all landscape materials be installed and maintained and any materials that do not
survive be replaced as soon as possible;
7. that no underground storage or burial of materials is permitted;
8. that the existing water service to the building be properly abandoned prior to occupancy
of the new building addition;
9. that a Conditional Use Permit in the General Flood Plain (Overlay) District is approved
to allow construction of the warehouse addition.
