Box 811, Ames, IA 50010 Phone: 515-239-5105 RESOLUTION NO. 26-519 RESOLUTION APPROVING VACATION OF ELECTRIC UTILITY EASEMENT FOR THE 161 KV TRANSMISSION LINE RELOCATED FOR THE IOWA DEPARTMENT OF TRANSPORTATION AND APPROVAL OF DISCLAIMER OF INTEREST IN REALTY FOR THE CITY OF AMES, IOWA WHEREAS, there is an existing electric easement on the property located at NE 126th Street and I-35 in Polk County; and, WHEREAS, the Iowa Department of Transportation (IDOT) made a request to vacate the existing electric utility easement located at NE 126th Street and I-35 in Polk County and for the City to approve a Disclaimer of Interest in Realty (DIR); and, WHEREAS, one of the terms of a reimbursement agreement the City has with the IDOT is that the City must approve a DIR which relinquishes any interest in real property that the City may have in certain prior recorded documents; and, WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on July 14, 2026, and a public hearing is being held regarding the proposal of the City to vacate the easement and to dispose of any interest it may have in real property; and, WHEREAS, vacation of the easement is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA THAT: 1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed vacation of the public utility easement and establishing a public hearing date regarding the proposal has been made. 2. The public hearing regarding the disposition of the property is hereby closed. 3. The Disclaimer of Interest in Realty (DIR) is approved, and the real estate described in an Option for Electric Line Easement recorded August 8, 2005, in Book 11215, at Pages 34-38, which was extended by a document recorded July 5, 2007, Books 12272, at Page 884, and exercised by the City of Ames, in a document recorded 12505, at Page 519, is hereby vacated.
