RESOLUTION NO. 26-492
RESOLUTION APPROVING VACATION OF EXISTING PUBLIC UTILITY EASEMENT
FOR DISCOVERY PLACE 2ND ADDITION SUBDIVISION
FOR THE CITY OF AMES, IOWA
WHEREAS, there is an existing 10-foot public utility easement located within
Outlot X of the subdivision; and,
WHEREAS, the public utility easement was created at the time of the original
platting of Iowa State University Research Park Third Addition to facility utility access to
the lots in the area; and,
WHEREAS, Discovery Place Second Addition created new public utility
easements to facilitate different alignments of utility access and the new easements
provide the same utility access to the area, so the existing public utility easements are no
longer necessary; and,
WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on July 14,
2026, and a public hearing is being held regarding the proposal of the City to vacate the
easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the
proposed vacation of the public utility easement and establishing a public hearing date
regarding the proposal has been made.
2. The public hearing regarding the disposition of the property is hereby
closed.
3. The 10 feet of the existing public utility easement across the following
described land is hereby vacated,
Discovery Place 2nd Addition Subdivision at a part of outlot X, Discovery Place
Second Addition, An Official Plat in the city of Ames, Story County, IA, Beginning at the
Northeast Corner of said outlot X; thence South 02 55’45” West along the East line of
said outlot X 239.99 feet to an easterly corner of said outlot X, thence south 41 14’15”
West continuing along said East line, 356.88 feet to the Southeast corner of said outlot
X, thence North 88 45’15” West along the South line of said outlot X, 670.27 feet: thence
North 65 18’56” East, 22.87 feet: thence South 88 45’15” East , 645.04 feet: Thence North
41 14’15” East, 348.74 feet: Thence North 02 55’45” East, 236.37 Feet to the North line
of said outlot X; thence South 87 53’37” East along said North line, 10.00 Feet to the point
of beginning and containing (12.487S.F.), all in Ames, Story County, IA
ADOPTED THIS 28th day of July, 2026.
