HomeMy WebLinkAboutA015 - Resolution approving amendment to Intergovernmental Agreement for Combined Law Enforcements Investigation of Controlled SubstancesITEM #:17 DATE:06-23-26 DEPT:POLICE SUBJECT:AMENDED INTERGOVERNMENTAL AGREEMENT FOR COMBINED LAW ENFORCEMENT INVESTIGATIONS OF CONTROLLED SUBSTANCES COUNCIL ACTION FORM BACKGROUND: The Central Iowa Drug Task Force (CIDTF) has been in existence since 1991. The goal of the CIDTF has consistently been focused on interrupting the trafficking and sale of controlled substances. The nature of drug trafficking frequently leads to larger scale, more complex, inter-jurisdictional investigations. Although agency membership has changed over time, the Ames Police Department, Iowa State University Department of Public Safety, Story County Sheriff's Office, Story County Attorney, Boone County Sheriff's Office, City of Boone, as well as State partners are the current members. The CIDTF operates through an Intergovernmental Agreement. An amendment has been prepared to clarify that officers and investigators to the task force maintain authority to investigate and charge offenses tangentially related to the trafficking and sales of controlled substances. Officers will also assist other agencies and task forces in their respective investigations as necessary, and respond to calls for assistance. The amendment is attached for the City Council's review and approval. ALTERNATIVES: 1. Approve the attached Intergovernmental Agreement for Combined Law Enforcement Investigations of Controlled Substances as amended. 2. Do not approve the Intergovernmental Agreement for Combined Law Enforcement Investigations of Controlled Substances as amended. CITY MANAGER'S RECOMMENDED ACTION: The work of the Central Iowa Drug Task Force is typically rated as a high priority in the City's annual Citizen Satisfaction Survey. In addition, the nature of illegal controlled substance distribution often requires shared investigative resources and multi-jurisdictional cooperation. The amendment only clarifies the current practice that task force officers may also investigate other offenses tangentially related to the investigation of the trafficking and sale of controlled substances. Therefore, it is the recommendation of the City Manager that the City Council adopt Alternative No. 1 as described above. ATTACHMENT(S): CIDTF amendment re other investigations 5.18.2026.docx 1 AMENDMENT NO. 3 To 28E Agreement For INTERGOVERNMENTAL AGREEMENT FOR COMBINED LAW ENFORCEMENT INVESTIGATIONS OF CONTROLLED SUBSTANCES (Filing No. M510990) Dated: ________________ Iowa Code Section 28E.12 This AMENDMENT No. 3 is made by and among the County of Story, Iowa, the City of Ames, Iowa, Iowa State University of Science and Technology, the County of Boone, Iowa, and the City of Boone, Iowa with their respective law enforcement agencies, the Story County Sheriff’s Office (hereinafter “SCSO”), the Boone County Sheriff’s Office (hereinafter “BCSO”), the Ames Police Department (hereinafter “Ames PD”), and the Boone Police Department (hereinafter “Boone PD”) SECTION 1. AMENDMENT 1. The parties hereby agree that an amendment should be made to the Central Iowa Drug Task Force Intergovernmental Agreement (Filing No. M510990) for the following reasons: a. To clarify that officers and investigators assigned to the task force by their respective agencies maintain authority to investigate and charge offenses tangentially related to the trafficking and sales of controlled substances, to assist other agencies and task forces in their respective investigations as necessary, and to respond to calls for assistance. 2. Section “I. Purpose” is therefore amended to include the following new paragraph: “WHEREAS, the parties recognize that the trafficking and sales of controlled substances can result in, and is frequently associated with, tangential crimes beyond and in addition to strict drug offenses, including but not limited to the possession or trafficking of illegal firearms, property offenses, human trafficking, sex abuse, and other violent offenses;” 2 3. Furthermore, Section “IV. Authority of Participating Officers” is hereby amended to include the following new paragraph: “This agreement shall not be construed to proscribe officers and investigators assigned to the CIDTF from investigating or charging crimes tangentially related to trafficking and sales of controlled substances, including but not limited to possession or trafficking of illegal firearms, property offenses, human trafficking, sex abuse, and violent offenses; nothing in this agreement shall be construed to proscribe officers and investigators assigned to the CIDTF from responding to emergency situations, responding to calls for assistance, or otherwise assisting other agencies and task forces in their respective investigations as necessary.” SECTION 2. AUTHORITY AND SCOPE. 1. Section “X. Amendments/Termination” permits this amendment if all parties are notified in writing of the proposed amendment and the reasons for it. 2. All other terms and conditions of the agreement identified in the caption above shall remain in full force and effect except as specifically modified by this amendment.
