RESOLUTION ASSESSING COSTS OF
TREE REMOVAL EMERGENCY ORDER FOR COLLECTION
IN THE SAME MANNER AS A PROPERTY TAX
PURSUANT TO SECTION 5.407, CODE OF IOWA,
FOR THE CITY OF AMES, IOWA
WHEREAS, the City of Ames has served notice on the property owner of 624 Duff
Avenue by certified mail regarding the dangerous tree located on their property; and,
WHEREAS, following multiple unsuccessful attempts to contact the property owner,
the City proceeded with removal of the tree; and,
WHEREAS, the property owner contacted the City regarding the uncertainty about
their ability to pay for the work. City Council directed staff to reduce the assessed cost to
$4,000 and the assessed cost be paid over a term of 10 years, in the same manner as
property tax, with an annual rate equal to the yield on a 10-year U.S. Treasury (4.59%).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames,
Iowa, that pursuant to Section 5.407, Code of Iowa, the cost of the tree removal is assessed
to the property as follows:

The said assessments to be due and collected in the same manner as property taxes.
That said assessment shall be payable in ten installments and shall bear interest at a rate
of 4.59% per annum, from the date of the acceptance of this assessment schedule; each
installment with interest on the whole assessment from the date of acceptance of this
assessment schedule by the Council, shall become due and payable on July 1, 2026, and
shall be paid at the same time and in the same manner as the September semiann ual
payment of ordinary taxes. Said assessment shall be payable at the office of the County
Treasurer of Story County, Iowa.
ADOPTED THIS 9th day of June, 2026.
