RESOLUTION CONDITIONALLY APPROVING A WAIVER OF ACCESS
LIMITATIONS TO AN ARTERIAL STREET (GW CARVER AVENUE) OF CHAPTER
23 OF THE AMES MUNICIPAL CODE TO ALLOW FOR A DRIVEWAY TO ACCESS
A SENIOR LIVING FACILITY FROM GW CARVER AVENUE
FOR THE CITY OF AMES, IOWA
WHEREAS, Lot 4 of The Bluffs Subdivision has frontage upon three streets,
including GW Carver Avenue, a locally defined arterial street.
WHEREAS, the City of Ames employs access management strategies to arterial
streets, which includes limited access controls for newly created lots.
WHEREAS, the City of Ames Subdivision Code allows for City Council to approve a
waiver of Chapter 23 standards, subject to certain findings.
WHEREAS, Lot 4 has a prospective buyer (Dover Development) intending to
develop a Senior Living Facility on the site and desires to have direct access to the facility
from GW Carver Avenue.
WHEREAS, a traffic study was completed to evaluate potential impacts of
development and planned roadway improvements along GW Carver. The City’s traffic
engineer determined that with a reduction in speed based upon future improvements that
a low volume driveway for a Senior Living Facility would be able to meet SUDAS design
requirements with improvements to GW Carver Avenue to allow for a protected turn lane
to access the site.
WHEREAS, the final design of the roadway improvements and the driveway
connection have not yet been completed, but an estimate of a minimum of 50 feet of
storage and appropriate tapers depending on roadway speed are required for a driveway
connection.
WHEREAS, the City of Ames in partnership with Story County are considering a
roadway improvement to GW Carver Avenue and it is in the interest of the City for any
turn lane improvement to be coordinated with any planned roadway improvements and
that the owner of Lot 4 may be required to contribute to a City roadway improvement
estimated at cost of $125,000.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames,
Iowa, that a Waiver of an access limitation to allow for a Driveway connection to GW
Carver Avenue is approved subject to the contingent future approval a development
agreement with the owner of Lot 4 that is acceptable to the Ames City Council, at their
sole discretion, for the final design of a driveway connection and corresponding
improvements to GW Carver Avenue for protected turning movements into Lot 4 per City
specifications; additionally the improvements are to be constructed by the Lot 4 owner at
their cost or the payment of cash in lieu to the City by the owner of Lot 4 for the
construction of said improvement by the City as part of a larger City roadway improvement
is hereby approved.
