RESOLUTION NO. 26-038
RESOLUTION APPROVING VACATION OF EASEMENT
WITHIN LOT 3 OF PETE COOPER SUBDIVISION
(400 FREEL DRIVE)
FOR THE CITY OF AMES, IOWA
WHEREAS, there are that two ten-foot wide existing public utility easements
located approximately 385' east of Freel Drive (within Lot 3) and 835' east of Freel Drive
(along the east line of Lot 3, within the original Lot 1) of the property located at 400 Freel
Drive; and,
WHEREAS, the contract holder made a request to vacate both of the easements;
and,
WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on the 23rd
day of December, 2025, and a public hearing is being held regarding the proposal of the
City to vacate the easements; and,
WHEREAS, vacation of the easements is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the
proposed vacation of the public utility easement and establishing a public
hearing date regarding the proposal has been made.
2. The public hearing regarding the disposition of the property is hereby
closed.
3. The existing public utility easements across the following described land is
hereby vacated:
The west 10 (ten) feet of Lot 3, Pete Cooper Subdivision, City of Ames,
Story County, Iowa, except the south 108.9 feet. The east 10 (ten) feet of
the west 395.03 feet of the south 108.90 feet of Lot 3, Pete Cooper
Subdivision, City of Ames, Story County, Iowa.
ADOPTED THIS 13th day of January, 2026.
