RESOLUTION NO. 25-587
RESOLUTION APPROVING VACATION OF ELECTRIC EASEMENT
FOR 1411 S GRAND AVENUE
FOR THE CITY OF AMES, IOWA
WHEREAS, an existing electric easement was established in 2009 during approval
of the final plat for Grand Aspen 3rd Subdivision for the property located at 1411 S. Grand
Avenue; and,
WHEREAS, in 2012, a new electrical easement was created at 1411 S. Grand
Avenue and the electrical service line was relocated to this new easement. Thus, the
existing 2009 easement must be vacated; and,
WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on the 28th
day of October, 2025, and a public hearing is being held regarding the proposal of the
City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the
proposed vacation of the public utility easement and establishing a public
hearing date regarding the proposal has been made.
2. The public hearing regarding the disposition of the property is hereby
closed.
3. The entirety of the existing 2009 electric easement across the following
described land is hereby vacated, while maintaining existing 2012 electric
easement:
A strip of land lying in Lot 1, Grand Aspen Subdivision, 4th Addition to Ames,
Story County, Iowa, being more particularly described as follows:
Commencing at the Southwest Corner of said Lot 1; N89° 42'33" E, 290.00
feet along the South line of said Lot 1 to the point of beginning; thence N00°
24' 59” W, 347.39 feet to the North line of said Lot 1; thence N89° 33’ 03”
E, 20.00 feet along said line; thence S00° 24' 59'' E, 347.45 feet to the South
line of said Lot 1; thence 509° 42' 33” W, 20.00 feet to the point of beginning,
containing 0.16 acres.
ADOPTED THIS 18th day of November, 2025.
