OF THE AMES CITY COUNCIL
AMES, IOWA JUNE 20, 1995
The Ames City Council met in special session at 12:03 p.m., June 20, 1995, in Conference Room
235 in the City Hall, 515 Clark Avenue, pursuant to law with Mayor Pro Tem Parks presiding and
the following Council Members present: Campbell, Hoffman, Parks, and Wirth. Couns. Brown and
Tedesco, and Mayor Curtis were absent.
EMERGENCY RESOLUTION WAIVING FORMAL BIDDING PROCEDURES, AND
AUTHORIZING CITY MANAGER TO SIGN CONTRACT FOR REPAIR SERVICES OF
UNIT #8 BOILER: Motion by Hoffman, Second by Campbell, to adopt
RESOLUTION NO. 95-271 declaring an emergency situation regarding repair
to a public improvement, waiving formal bidding procedures to expedite
repairs of Unit #8 Boiler, and authorizing the City Manager to award and
sign a contract with Babcock and Wilcox for repair services to Unit #8 Boiler
at a cost not to exceed $300,000 without additional City Council approval.
Roll Call Vote on Motion: 4-0. Resolution declared adopted unanimously,
signed by the Mayor, and hereby made a portion of these minutes.
COMMENTS: Coun. Wirth noted the Council had received a letter dated June 20, 1995, from
Nancy Miller and Ron Evans, Co-Chairs of the Downtown Betterment Association, asking the City
to support the downtown area's "harassment of the birds" project this year, as they did last year.
Coun. Hoffman said she'd received a request for repair of a water fountain at O'Neil Park.
Coun. Hoffman noted she'd received a phone call from a citizen who had appeared before the Zoning
Board of Adjustment for a permit to operate a day care facility in her home. She said although the
State Code allows a facility to accommodate up to six children, the Ames Municipal Code restricts
the number of visits to a facility to 10 visits per day. She said the City's restriction doesn't allow for
dropping off and picking up of 6 children, and allows no provision for extra trips that might be
required in certain circumstances.
Motion by Hoffman, Second by Campbell, to refer to Staff the possibility of
an exception to the Ames Municipal Code requirements for Home Occupation
permits regarding number of daily visits allowed to day care facilities.
Vote on Motion: 4-0. Motion declared carried unanimously.
Coun. Hoffman noted in their June 16th non-agenda packet, the Council members had received a
letter from the North Hyland Neighborhood Association, dated May 24, 1995 and received in the
City Clerk's Office on June 12, 1995, regarding "New issues regarding the 37' Hyland Road."
Coun. Parks said he had received a call concerning noise created by snow blowers, and how
emergency situations might require early morning snow removal and thus an exception to the noise
permit ordinance.
Motion by Parks, Second by Hoffman, to direct the City Attorney to prepare
an ordinance providing for exceptions to the noise permit ordinance to allow
for use of snow blowers in emergency situations.
Coun. Campbell said she questioned how often such situations would arise, and whether a change
in the City's ordinance was warranted.
Vote on Motion: 2-2. Voting Aye: Hoffman, Parks. Voting Nay:
Campbell, Wirth. Mayor Pro Tem Parks voted Aye to break the tie. The
Motion was declared carried 3-2.
Coun. Hoffman said she'd received some concerns regarding grass growing in undeveloped lots.
Coun. Wirth said she'd received similar concerns and suggested the Council should consider a
Minimal Property Maintenance Code. Coun. Parks said it might be appropriate to raise this topic
during the Council Comments section of a future agenda, when the other Council members would
be present.
ADJOURNMENT: The meeting adjourned at 12:25 p.m.
