OF THE AMES CITY COUNCIL
AMES, IOWA MAY 19, 1998
The Ames City Council met in special session at 5:00 p.m. on the 19th day of May, 1998, in the City
Council Chambers in City Hall, 515 Clark Avenue, pursuant to law with Mayor Ted Tedesco presiding
and the following Council members present: Campbell, Hoffman, Quirmbach, and Wirth.
CALL TO ORDER: 5:06 p.m.
Mayor Tedesco welcomed Mr. Duea’s American Government class from Ames High.
WORKSHOP FOR PROPOSED ZONING ORDINANCE:
This meeting will review the “red flag” issues from previous workshops. Before beginning the
workshop, Mayor Tedesco asked that Brian O’Connell present the recommendations for each issue
suggested by the City staff for Council’s review.
Article 2 - Rules of Construction and Definitions
P. 2-5 lines 14-16 Moved by Wirth, seconded by Hoffman, to change definition of “family” to
include one or more related persons occupying a dwelling unit and living as a
single nonprofit housekeeping unit. No more than three unrelated persons shall
also constitute a family. For the purpose of this definition, related persons shall
include a mother, father, foster parent, husband, wife, son, daughter, foster child,
brother, sister, grandchild, grandparent, great-grandparent, mother-in-law,
father-in-law, son-in-law, brother-in-law, sister-in-law, step-father, step-mother,
step-child, step-brother, or step-sister. Unrelated persons are persons who do
not meet the definition of related persons.
VOM: 3 - 1. Voting Aye: Campbell, Hoffman, Wirth. Voting Nay: Quirmbach.
Motion passed.
P. 2-15 line 28A Moved by Hoffman, seconded by Campbell, to insert the Staff’s recom-
mendation for the definition of “Townhouse” as a one family dwelling in a row
of at least two such units in which each unit has its own front and rear access to
the outside, no unit is located over another unit and each unit is separated from
any other unit by one or more common fire resistant walls. Each townhouse unit
shall be located on its own lot.
VOM: 4- 0. Motion declared carried unanimously.
Article 3 - Flag lot Standards
P. 3-4 lines 20-23 Moved by Quirmbach, seconded by Campbell, to accept the revisions to
standard 3.4B.3.C: For flag lots that are to be created in residential zones, both
the “front lot” and the “rear lot” that are created after the effective date of this
ordinance shall have an area that is equal to or greater than 10,000 square feet
or 150% of the lot area for the zone in which the flag lots are proposed to be
created, whichever is greater. In all other zoning districts, both the “from lot”
and “rear lot” shall conform to all minimum lot area and other dimensional
standards applicable to the zone in which the lots are located, provided,
however, that the “access strip” serving the rear lot shall not be included in
computing the minimum lot area for the front and rear lot.
VOM: 4 - 0. Motion declared carried unanimously.
P. 3-4 line 25 Moved by Quirmbach, seconded by Wirth, to add the additional standard
3.4B.3.e for flag lots: The front setback of “rear lot” and the rear setback of
“front lot” for flag lots created in residential zones shall be one and one-half
times the distance of the setbacks that are established for all other lots in the
same residential zoning district.
VOM: 4 - 0. Motion declared carried unanimously.
P.3-6 lines 3,15 Moved by Campbell, seconded by Hoffman, to delete the words “or other value”
on line 3, the words “on other” on line 15, and the word “or” before the word
“economic” on line 15. Council may determine to waive some or all of zone
development standards or general development standards for structures of
historic, architectural, or economic value.
VOM: 4 - 0. Motion declared carried unanimously.
P. 3-6 Moved by Wirth, seconded by Hoffman, to add the statement to Section 3.7 that
the Historic Preservation Commission acts as the advisory body to the City
Council in all matters relating to adaptive reuse on properties throughout the city
which are deemed to be of historic and architectural significance.
VOM: 3 - 1. Voting Aye: Campbell, Hoffman, Wirth. Voting Nay:
Quirmbach. Motion passed.
Article 4 - Required Landscape Elements
P. 4-5 line 149 Moved by Wirth, seconded by Hoffman, to rewrite the first sentence to read:
“Low Shrubs, spaced at a maximum distance of 4 feet on center, must form a
continuous screen 3 feet high.
P. 4-5 line 159 The L3 standard requires High Shrubs spaced at a maximum distance of 6 feet
on center to form a screen 6 feet high.”
VOM: 4 - 0. Motion declared carried unanimously.
P. 4-6, line 20 Moved by Campbell, seconded by Hoffman, to add the definition of “Low
Shrubs” and “High Shrubs.” The definition of “Low Shrubs” is shrubs with a
mature height of 3 to 6 feet. The definition of “High Shrubs” is shrubs with a
mature heightof 6 feet or greater.
VOM: 4-0. Motion declared carried unanimously.
Councilperson Russ Cross arrived at 7:48 p.m.
P. 8-10, Table 8.4(C) Moved by Campbell, seconded by Hoffman, to change the development
standard for “drive-through facilities permitted” to “No, with the exception of
financial institutions,” in Table 8.4(C).
VOM: 4 - 1. Voting Aye: Campbell, Cross, Hoffman, Wirth. Voting Nay:
Quirmbach. Motion passed.

Article 5 - Accessory Uses
P. 5-1 lines 24-25 Moved by Wirth, seconded by Hoffman, to delete lines 24 and 25 and insert:
“accessory uses are incidental only to a principle use and an accessory use need
not be located within the principle structure.”
VOM: 5 - 0. Motion declared carried unanimously.
P. 5-2 lines 36-39 Moved by Campbell, seconded by Hoffman, to revised Section 5.2C.5.e as
follows: “...has a gross area, that, in combination with all uses accessory to
Principle Uses located in the same structure or on the same lot does not exceed
25% of gross floor area utilized by all Principle Uses. This 25% limitation,
however, shall not apply to off-street parking.”
VOM: 3 - 2. Voting Aye: Campbell, Hoffman, Wirth. Voting Nay: Cross,
Quirmbach. Motion passed.
Councilperson Sharon Wirth left the meeting at 8:05 p.m.
Article 8 - Commercial Zones
P. 8-2, Table 8.2(B) Moved by Campbell, seconded by Cross, to change approval authority from
P. 8-19, Table 8.6(B) “City Council” to “Staff” in the Neighborhood Commercial, Planned Regional
P. 9-7, Table 9.3(B) Commercial, and Planned Industrial Zones.
VOM: 4 - 0. Motion declared carried unanimously.
Article 7 - Development Standards for Townhouses
P. 7-7, Table 7.3(C) Moved by Hoffman, seconded by Campbell, to revise Table 7.3(C) by replacing
“Each Unit Over 2" with “Multiple Family Dwelling Units over 2 units”, replace
“1,800 sf each additional” with “1,800 sf each unit,” and add “Townhome” to
the “Development Standards,” and add “3,500 sf per unit” under “RM Zone” for
townhomes, in Table 7.3(C).
VOM: 4 - 0. Motion declared carried unanimously.
P. 7.7, Table 7.3(C) Moved by Campbell, seconded by Cross, to add “Side Lot Line (party wall line
for Townhomes)” to the “Deelopment Standards” and “0 ft.” to the “RM Zone”
for the Side Lot Line for Townhomes in Table 7.3(C).
VOM: 4 - 0. Motion declared carried unanimously.
Moved by Hoffman, seconded by Cross, for Staff to correct terminology regarding Townhouses and
the party wall to use consistent terminology throughout.

P. 7-5, Table 7.5(C) Moved by Cross, seconded by Hoffman, to revise Table 7.5(C) by replacing
“Each Unit Over 2" with “Multiple Family Dwelling Units over 2 Units,”
replace “1800 sf each additional” with “1,800 sf each unit,” add “Townhome”
to the “Development Standards” and add “3,500 sf per unit” under “RH Zone”
for townhomes. Add “Side Lot Line (party wall for Townhomes)” to the
“Development Standards” and “0 ft.” to the “RH Zone” for the Side Lot Lot for
Townhomes.
VOM: 4 - 0. Motion declared carried unanimously.

Article 13 - Home Occupations
P. 13-3 line 86 Moved by Hoffman, seconded by Cross, to include “Architects and Engineers”
as “Permitted Home Occupations” in 13.5A.1.i. Delete “engineers, architects”
from 13.5A.2.h.
VOM: 4 - 0. Motion declared carried unanimously.
Moved by Cross, seconded by Hoffman, for Staff to review off-street parking
requirements for fast food restaurants to reflect the size of the dining area and
come back to the next meeting of the City Council with recommendations.
VOM: 4 - 0. Motion declared carried unanimously.
Mayor Tedesco announced that Council and Staff will continue with the discussion of red flags on
Article 7 at the next meeting on May 28th
.
Moved by Hoffman, seconded by Campbell, to direct staff to address the issue of approvals needed for
joining lots, and return to the Council with recommendations.
VOM: 4 - 0. Motion declared carried unanimously.
COMMENTS:
Moved by Campbell, seconded by Hoffman, to refer the letter from Hubbell regarding the Garden Cafe
to Staff.
VOM: 3-0-1. Voting Aye: Campbell, Hoffman, Quirmbach. Voting Nay: None. Abstaining: Cross.
Motion passed.
