Box 811, Ames, IA 50010 Phone: 515-239-5105 RESOLUTION NO. 25-302 RESOLUTION APPROVING VACATION OF ELECTRIC UTILITY EASEMENT AT 2125 ISAAC NEWTON DRIVE FOR THE CITY OF AMES, IOWA WHEREAS, there is an existing 1,722.51 square foot electric easement on the property located at 2125 Isaac Newton Drive; and, WHEREAS, the property owner made a request to vacate the existing electric utility easement as the electric transformer is located outside the electric utility easement boundaries; and, WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on May 27, 2025, and a public hearing is being held regarding the proposal of the City to vacate the easement; and, WHEREAS, vacation of the easement is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA THAT: 1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed vacation of the public utility easement and establishing a public hearing date regarding the proposal has been made. 2. The public hearing regarding the disposition of the property is hereby closed. 3. The 1,722.51 square feet of the existing public utility easement across the following described land is hereby vacated: A STRIP OF VARYING WIDTH ACROSS PARCEL D IN LOTS 6 AND 7, SOUTH GATEWAY DEVELOPMENT AND LOT 2, SOUTH GATEWAY DEVELOPMENT, PLAT 2, ALL IN THE CITY OF AMES, STORY COUNTY, IOWA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF THE SAID PARCEL D; THENCE N00°15’14”W, 250.75 FEET ALONG THE WEST LINE THEREOF; THENCE N89°44’57”E, 55.17 FEET; THENCE N29°39’34”E, 5.32 FEET; THENCE S60°20’26”E, 15.00 FEET; THENCE S29°39’34”W, 15.00 FEET; THENCE N60°20’26”W, 15.00 FEET; THENCE N29 °39’34”W, 15.00 FEET; THENCE N60°20’26”W, 15.00 FEET; THENCE N29°39’34”E, 3.91 FEET; THENCE S89°44’57”W, 47.29 FEET; THENCE S00°15’14”E, 245.79 FEET TO THE SOUTH LINE OF SAID PARCEL D; THENCE N89°49’16”W, 5.00 FEET TO THE POINT OF BEGINNING.
