HomeMy WebLinkAbout~Master -Release from Prior Development and Contract Rezoning Agreement for JT Warehouse Subdivision on E 13th StreetRESOLUTION NO. 25-104 RESOLUTION ACKNOWLEDGING RELEASE OF SITE FROM DEVELOPMENT AND CONTRACT REZONING AGREEMENT FOR JT WAREHOUSE SUBDIVISION ON EAST 13TH STREET FOR THE CITY OF AMES, IOWA WHEREAS, the property owners of Lots 1 and 2 (“Owners”) in the JT Warehouse Subdivision, an Official Plat (“East Barilla Site”), located at 3910 and 4098 East 13th Street requested a release of the East Barilla Site from An Agreement Pertaining to the Rezoning and Development of Land in the City of Ames dated November 8, 2007, and recorded in the Recorder’s Office of Story County, Iowa, as Instrument No. 2007-14279 (“Agreement”); and, WHEREAS, approval of the request would not subject the East Barilla Site to the original "Regional Mall" Development Agreement conditions effectuated in 2007 for commercial development under Planned Regional Commercial (PRC) and the Northeast Gateway Overlay (O- GNE) zoning for three sites referred to as the North Site, South Site, and East Barilla Site; and, WHEREAS, the acknowledgement by the City for the release of the East Barilla Site from the Agreement is necessary because the East Barilla Site is not zoned PRC or O-GNE which is consistent with the City's 2023 rezoning of the site to General Industrial; and, WHEREAS, Owners seeks this acknowledgement from the City because the Agreement prohibits applying for any form of tax abatement related to the East Barilla Site. However, the City traditionally offers an option to apply for Industrial Tax Abatement for qualifying uses within the General Industrial zoning district. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the acknowledgment of release and removal of the East Barilla Site from any and all obligations of the Agreement is hereby approved and the Agreement is of no further effect on the East Barilla Site.
