AMES, IOWA DECEMBER 10, 2021
The Special Meeting of the Ames City Council was called to order by Mayor John Haila at 9:13 a.m.
on the 10th day of December, 2021. As it was impractical for the Mayor and Council Members to
participate in person, Mayor Haila and Council Members Gloria Betcher, Amber Corrieri, Rachel
Junck, and David Martin were brought in via Zoom. Council Members Bronwyn Beatty-Hansen and
Tim Gartin were absent. Ex officio Member Trevor Poundstone was absent.
IOWAY CREEK RESTORATION AND FLOOD MITIGATION PROJECT: Municipal
Engineer Tracy Peterson stated that the construction and excavation for the Flood Mitigation site on
South Duff has begun. On the east side of the site there are three properties where the contractors
have encountered an excessive quantity of old car parts. As the crews were pulling up tree stumps,
there were tires that were buried and the trees have grown over. The entire southeast quadrant had
buried car parts, and in order to separate the soil from the buried car parts, staff will need to sift the
soil and bring in special equipment to screen the process. Ms. Peterson noted that at this time the car
parts have been considered non-hazardous, but if staff encounters pockets where there is oil, sheen,
or fuel, they will have to properly dispose of those items as they would be considered hazardous
materials. She indicated that there are bid items in the Contract for any hazardous or non-hazardous
items that will get carted off. Change Order Number 1 is for the additional equipment and time it will
take to shift out and screen the garbage car parts and tires that have been found.
The Mayor inquired as to how deep staff will need to dig and whether more money need to be asked
for later for this project. Ms. Peterson explained that the staff has estimated how deep they need to
go, but won’t know until they start excavating more. The amount on the Change Order is a lump sum
quantity for shifting, and the tonnage for the hazardous/non-hazardous material will be paid within
the bid items that are already in the contract. She noted that one good thing is the City had bid the
Burke and Brown properties as one as that is where the majority of the hazardous/non-hazardous
materials were located. Mr. Burke had worked with Mr. Howe to remove a lot of the heavy metal
and excess from the site, which did help with some savings. Mayor Haila asked if there would be
any credit coming back to the project since some removal was done prior to the project. Ms. Peterson
indicated that it isn’t anticipated as the amount of any savings is going to be used to pay for the
tonnage on the materials removed.
Mayor Haila inquired if there is any recourse on the property owner or for anyone that did the
investigation. Ms. Peterson mentioned that staff was working with the Legal Department to see if
there is anything to be done.
The Mayor opened public comment and it was closed when no one spoke.
Moved by Betcher, seconded by Junck, to adopt RESOLUTION NO. 21-598 approving Change
Order No. 1 in the amount of $107,410.
Roll Call Vote: 4-0. Resolution declared adopted unanimously, signed by the Mayor, and hereby
made a portion of these Minutes.
Moved by Betcher, seconded by Junck, to adopt RESOLUTION NO. 21-599 authorizing up to
$100,000 in unallocated General Obligation Bonds for the Ioway Creek Restoration and Flood
Mitigation Project.
Roll Call Vote: 4-0. Resolution declared adopted unanimously, signed by the Mayor, and hereby
made a portion of these Minutes.
DISPOSITION OF COMMUNICATIONS TO COUNCIL: The Mayor indicated the one item
under Disposition will be addressed at the Regular City Council meeting on December 14, 2021.
COUNCIL COMMENTS: Council Member Betcher commented that she felt it was good that
the City is doing the mitigation as she wondered what would have happened if these properties
continued to remain in private hands. She thought it was environmentally sound that the City is
cleaning this up and hoped there will not be any future surprises.
ADJOURNMENT: Moved by Betcher to adjourn the meeting at 9:20 a.m.
