RESOLUTION NO. 24-635
RESOLUTION SETTING DATE OF PUBLIC HEARING FOR
VACATION OF EASEMENT
AT ASPEN RIDGE SUBDIVISION, 2ND ADDITION,
AND GRAND ASPEN RIDGE SUBDIVISION, 2ND ADDITION
FOR THE CITY OF AMES, IOWA
WHEREAS, the owner of Aspen Ridge Subdivision, 2nd Addition, and Grand Aspen Ridge
Subdivision, 2nd Addition requested that the following existing easements be vacated by the City
of Ames:
• Existing 5-foot Public Utility Easement located at Part of Parcel C of Lot 1 and 5-Foot
Public Utility Easement located at Part of Lot 2, Aspen Ridge Subdivision, 2nd Addition
• Existing twenty-foot (20') Ingress/Egress Easement, 10-foot Sanitary Sewer, Slope
Easement, West Line Access Point Restriction and 20-foot Public Utility Easement located
at Part of Parcel C of Lot 1, Part of Lot 2, Part of Part A, Lot 3, Aspen Ridge Subdivision,
2nd Addition, & Part of Outlot C, Grand Aspen Subdivision, 2nd Addition
• Existing ten-foot (10') Drainage easement located at Part of Parcel B of Lot 3 of Aspen
Ridge Subdivision, 2nd Addition Existing ten-foot (10') Public Utility Easement located at
Part of Parcel D of Aspen Ridge Subdivision, 2nd Addition
• Existing fifty foot (50') Shared Access and Public Utility Easement located at Part of Parcel
B of Lot 3 of Aspen Ridge Subdivision, 2nd Addition; and,
WHEREAS, pursuant to Iowa Code section 364.7, it is necessary to provide notice of and
hold a public hearing regarding the proposal of the City to dispose of its interest in this real
property; and,
WHEREAS, following notice and public hearing, the City will determine if this proposal
is appropriate.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF AMES, IOWA, THAT:
1. Pursuant to Iowa Code section 364.7, publication of notice regarding the proposed
vacation of the aforementioned easements and establishing a public hearing date
regarding the proposal is required.
2. The public hearing regarding the proposal to consider vacation of the City’s interest
in the aforementioned easements at Aspen Ridge Subdivision, 2nd Addition, and
Grand Aspen Ridge Subdivision, 2nd Addition shall be held on the 10th day of
December 2024, at 6:00 p.m.
3. The City Clerk is hereby directed to provide notice of the public hearing as required
by Iowa Code section 362.3.
