HomeMy WebLinkAbout~Master - Approving Vacation of 10' Strip of Right-of-Way Adjacent to 302 and 212 Sondrol Avenue DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by: City Clerk's Office,515 Clark Avenue,Ames,IA 50010 Return to: Ames City Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 24-429 RESOLUTION APPROVING VACATION OF 10' STRIP OF RIGHT-OF-WAY ADJACENT TO 302 AND 212 SONDORL AVENUE FOR THE CITY OF AMES,IOWA WHEREAS, City staff was approached by the owner of 302 and 212 Sondrol Avenue requesting the vacation and conveyance of a 10 foot strip of right-of-way adjacent to their property; and, WHEREAS, the property owner, Mechanical Comfort, currently located at 302 Sondrol Avenue desires to expand their facility south onto 212 Sondrol Avenue, which they also own; and, WHEREAS, the vacation of the right of way is needed to meet zoning regulations for the proposed new parking lot and landscaping associated with the building expansion; and, WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on July 9, 2024, and a public hearing is being held regarding the proposal of the City to vacate the 10' strip of right-of-way; and, WHEREAS,vacation of the right-of-way is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES,IOWA THAT: 1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed vacation of the right of way and establishing a public hearing date regarding the proposal has been made. 1 2. The public hearing regarding the disposition of the property is hereby closed. The 10 foot strip of public right-of-way across the following described land is hereby vacated: Being a part of Sondrol Avenue, of Second Addition to Sondrol's Subdivision and Sondrol's Third Addition, City of Ames, Story County, Iowa, more particularly described as follows: BEGINNING at the Northwest Corner of Lot 1, said Sondrol's Third Addition; thence S88°47'39"W on the Westerly extension of the North line of said Lot 1, a distance of 10.00 feet; thence S01°59'01"E, a distance of 151.84 feet to the South line of said Sondrol's Third Addition; thence S02°14'23"E, a distance of 36.44 feet; thence Southeasterly 116.39 feet on a 76.85 foot radius curve concave Northeasterly with a long chord bearing S45°18'49"E, 105.58 feet; thence S88°50'57"E, a distance of 88.67 feet to the Southerly extension of the East line of Lot 3, said Second Addition to Sondrol's Subdivision; thence N01°06'48"W on said Southerly extension, a distance of 10.00 feet to the Southeast Corner of said Lot 3 (the following 3 courses are common to said Lot 3); thence N88°50'57"W, a distance of 88.24 feet; thence Northwesterly 101.25 feet on a 66.85 foot radius curve concave Northeasterly with a long chord bearing N45°18'49"W, 91.84 feet; thence NO2°14'23"W, a distance of 36.30 feet to the Southwest Corner of said Lot 1; thence N01°59'01"W on the West line of said Lot 1, a distance of 151.85 feet to the POINT OF BEGINNING, containing 3,855 square feet and being subservient to any and all prior easements, be they of record or not.
