HomeMy WebLinkAbout~Master - D&O to allow a termporay yard waste facility in GI zone districtCITY OF AMES, IOWA ZONING BOARD OF ADJUSTMENT IN THE MATTER OF THE APPLICATION OF CHAMNESS TECHOLOGY, INC., dlb/a CASE NO. 24-04 GREEN RU, LLC, FOR SPECIAL USE PERMIT TO ALLOW A TEMPORARY PARCEL IDS: 09-12-201-045 YARD WASTE FACILITY, AMES 09-12-251-160 MUNICIPAL CODE SECTIONS 29.1315 DECISION & ORDER AND 29.1503, IN THE GENERAL INDUSTRIAL ZONING DISTRICT AT 220 & 400 FREEL DRIVE FACTS This application came before the Board for a Special Use Permit to operate a Temporary Yard Waste Processing Facility at 220 & 400 Freel Drive in the General Industrial (GI) Zone. Planner Ray Anderson presented the application for a Special Use Permit for a Yard Waste and Collection Site to the Board. Planner Anderson explained that an extension was granted a year ago for a Special Use Permit that had been granted by the Board in 2022. Under the Ames Municipal Code, a Temporary Special Use Permit lasts for one year and can be extended for one additional year. The approval of the extension in 2023 included some conditions, one of which was that there would be no further extensions without filing for a new Temporary Special Use Permit. This current application must be approved prior to the expiration of the extension that was granted last year. The yard waste disposal site has remained at the same location since 2017. The 220 Freel location is used as an exit if needed for traffic control. There are no changes or site improvements, and the facility would continue to operate as it has this past year. There have been no complaints received about the site. FINDINGS AND DECISION The Board considered the facts as detailed above and provided in the Staff Report, the testimony presented at the hearing, and adopted the Factual Findings and Conclusions in the Staff Report and found that the project met the criteria consistent with zoning standards as established by the Applicant under Section 29.1503(4) of the Ames City Municipal Code. ORDER WHEREFORE, IT IS ORDERED that the Special Use Permit be CRAFTEDto allow for a one-year extension of the Special Use Permit to allow a temporary yard waste processing facility at 220 and 440 Freel. Drive, with the fallowing conditions: A. General operations on weekdays and weekends as described within the application and up to five large event days. B. Use of the site shall be consistent with the plan submitted as part of the Special Use Permit Application. C. The term of the use shall begin on May 1, 2024, and may continue for one year through May 1, 2025. All yard waste material, equipment, and temporary structures shall be removed from the site and the site restored to its current or better condition within sixty (60) days of the end of the permit. D. A single extension of up to one (1) year may be granted by the Zoning Board of Adjustment provided the initial Special Use Permit has not expired. Any person desiring to appeal this decision to a court of record may do so within thirty (20) days after the filing of this decision. Dated this 20"' day of March 2024.
