FACTS
This application came before the Board for a Special Use Permit to allow retail trade in an existing
building at 919 E. Lincoln Way. The property is zoned General Industrial (GI), which prohibits
retail uses that exceed 3,000 square feet without a special use permit. Overflow Thrift Store, Inc.,
proposes to purchase the property to operate its retail trade, and the retail space is approximately
14,700 feet on the main level with an additional 1,200 square feet on the mezzanine.
Ames Municipal Code §29.1503 sets forth the review criteria for Special Use Permits, and this
application requires that the general standards of §29.1503(5)(a) are met. Planner Benjamin
Campbell presented the staff report to the Board, which made findings that all general standards
were met. During the hearing, Planner Campbell noted that the site has two zoning noncompliance
issues that are unrelated to the application for a special use permit that must be resolved: (1) Trees
and shrubs required by the original site plan have died and not been replaced, and (2) Gravel placed
in the northwest corner of the property being used as a driveway and increased parking area.
Applicant Overflow Thrift Store represented that it would bring the property into compliance.
The Board accepted the staff report as evidence and heard further testimony from Sandy Swanson,
on behalf of the Applicant.
FINDINGS AND DECISION
The Board considered the facts as detailed above and provided in the staff report, the testimony
presented at the hearing, and adopted the Factual Findings and Conclusions in the Staff Report
and found that the project met the criteria consistent with zoning standards as established by the
Applicant under Section 29.1503(5)(a) of the Ames City Municipal Code.
WHEREFORE, IT IS ORDERED that the Special Use Permit be GRANTED to allow for allow
for retail trade within a General Industrial (CAI) Zoning District for the property located at 91.9 E.
Lincoln Way.
Any person desiring to appeal this decision to a court of record may do so within thirty (30) days
after the filing of this decision.
