Approval of the Conditional Use Permit by the Zoning Board of Adjustment in no way absolves the applicant from subsequently obtaining the necessary building permits or other permits from the City of Ames or from other applicable agencies. The Zoning Board of Adjustment may grant a Conditional Use Permit for an Alternate Method of Elevating a Residential Structure in the Floodway Fringe Overlay District, where topography, street grades, or other factors preclude elevating by fill. In such cases, the methods used must be adequate to support the structure as well as withstand the various forces and hazards associated with flooding. In order to facilitate review of this application for a Conditional Use Permit, the applicant shall submit evidence with the application to show why an alternate method of elevation is needed. Evidence shall also be submitted with this application to show that the proposed methods of elevation are adequate to support the structure as well as withstand the various forces and hazards associated with flooding. (Note: The applicant's answers to the questions that follow may be attached on a separate sheet if sufficient space is not provided.) I Evidence of the need for an alternate method of elevation. Please explain. Due to the site constrains and elevations the proposed building will have the primary living space on the second floor and covered parking on the first floor.The density requirements for the site based on the zoning designation required a minimum number of units which was proposed on the site. In order to provide the minimum number of units and adequate parking stalls the building had to be elevated to provide parking under the building. Due to site constraints the standard 18' of outward fill that is typically utilized was not able to be done. If 18' of outward fill was utilized there would not have been enough space for the building width and the required parking and driveway to be situated on the lot.The only option in order to meet the required site density was to elevate the building. 5 Effective Date: August 4, 2020 2. Evidence to show that the proposed method of elevation is adequate to support the structure as well as withstand the various forces and hazards associated with flooding. Please explain. Due to the site constrains and elevations the proposed building will have the primary living space on the second floor and covered arkin on the first floor. A small corner of the building in the NW portion of the site is located in the floodway fringe The covered parking area will be open on the east side of the site and a flood equalization opening® will be installed on the west face of the building per flood plain requirements The walls for the covered parking area were designed by a structural engineer to support the loads above and residential living space. The opening on the lower level will ensure all the forces are accounted for and not hazardous situations will occur. 6 Effective ®ate: August 4, 2020 OverlayConditional Use Permit for an Alternate Method of Elevating a Residential Structure in the Floodway Fringe Site Flan Checklist The applicant shall submit a Site Plan, drawn to scale, that clearly shows the subject property for which the Conditional Use Permit is being sought. If a Major or Minor Site Development Plan was submitted as part of the development approval process for the subject property, then that Major or Minor Site Development Plan should also be submitted with the Conditional Use Permit application. The Site Plan shall include at a minimum the following information: ❑ Description of the land on which the proposed work is to be done (i.e., lot, block, tract, street address, or similar description) that will readily identify and locate the work to be done ❑ Identification of the use or occupancy for which the proposed work is intended ❑ The base flood elevation (BFE) ❑ Elevation (in relation to National Geodetic Vertical Datum NGVD29) of the lowest floor (including basement) of buildings or of the level to which a building is to be flood-proofed ❑ For buildings being improved or rebuilt, the estimated cost of improvement and the market value of the building prior to the improvements ❑ Such other information as the Administrator deems reasonably necessary for the purpose of this ordinance, including: ❑ Dimensioned property lines ❑ Abutting streets and alleys ❑ Location and size of all existing and proposed buildings and structures (include distances to all property lines and distances between buildings and structures) ❑ Required setbacks ❑ Driveways and parking areas, fully-dimensioned ❑ Other pertinent information necessary to fully understand the need for a Conditional Use Permit (e.g.: significant change in topography, location and size of mature trees, etc.) 7 Effective ®ate: August 4, 2020 ermissi®n t® Place a "Zoning ActionPending"Sign ®n Private Property (This form must be filled out completely before your application will be accepted.) Section 29.1500(2)(d)(iii) of the Zoning Ordinance, requires that notice shall be posted by the City on the subject property. The owner of property at 403 Hyland hereby grants the City of Ames pennission to place "Zoning Action Pending" signs on the property for the purpose of informing interested persons of the request for action by the City of Ames. I understand that the signs will be placed on the property several days prior to action on the request by the Planning and Zoning Commission, Zoning Board of Adjustment, or the City Council, and may remain on the property until the request has been approved or denied by the City.
