HomeMy WebLinkAboutDO 3329 LINCOLN WAY CASE NO 22-09 CITE' OF AMES, IOWA KING BOARD OF ADJUSTMENT IN THE MATTED OF THE APPLICATION OF LUTHERAN CHUCH OF HOPE FOR A CASE NO. 22-09 SPECIAL USE PERMIT AMENDMENT, AMES MUNICIPAL CODE SECTION PARCEL ID: 09-OS-476-075 29.1503(4), LOCATED IN THE HIGHWAY DECISION & ORDER ORIENTED COMMERICIAL (HOC) ZONING DISTRCT AT 3329 LINCOLN WAY FACTS The Lutheran Church of Hope brought this application before the Zoning Board of Adjustment to obtain a Special Use Permit Amendment ("SUP Amendment') for the property at 3329 Lincoln Way. The Church planned to expand the existing worship space and modify related parking. The Church received the original SUP on June 23, 2021. The approved Special Use Permit demonstrated compliance with all City zoning standards, including thirty-one on-site parking spaces. City Staff determined that all conditions of the original SUP (Case No. 21-08) have been met. For this amendment, the Applicant proposed to expand their current worship area from 2,201 sq. ft. to 2,913 sq. ft. The enlarged worship area would require a total of forty-nine parking spaces, which is twelve more parking spaces than previously required. The Applicant entered into a Joint Use Parking Agreement with First National Bank to provide an additional fifteen parking spaces after banking hours on Wednesday evenings from 6:00 — 11:00 p.m. First National Bank is located diagonally across the street at 3334 Lincoln Way and is also in the Highway Oriented Commercial (HOC) Zoning District. Planner Eloise Sahlstrom presented the Staff Report to the Board and indicated that the parking requirements are met through remote parking, onsite parking, and the reductions in the bicycle parking. The expansion of the worship area will have no impact on the footprint of the building nor the exterior of the building. The Municipal Code requires that parking be within 300 feet of the subject site. The convenient access to a signalized crossing of Lincoln Way, met the minimum distance standard and was convenient and safe for use by attendees to Lutheran Church of Hope. The Church will meet required parking requirements due to the increase associated with the Joint Use Parking Agreement approved by City Council. The Applicant attended the meeting and declined oral testimony unless there were questions. The Board accepted and considered the Staff Report, the testimony presented at the hearing, and adopted the Factual Findings and Conclusions in the Staff Report. FINDINGS AND DECISION The Board considered the facts as detailed above and provided in the Staff Report and all evidence provided at the hearing. The Board adopted the findings in the Staff Report and found that the project met the criteria consistent with zoning standards as established by the Applicant under Section 29.1503(4) of the Ames City Municipal Code. ORDER WHEREFORE, IT IS ORDERED that pursuant to Section 29.1503(4) of the Ames City Municipal Code, the Application is GRANTED to allow for an amended Special Use Permit (Case No. 21-08) to allow expansion of the Church worship area to 2,913 sq. ft. within the existing building footprint at 3329 Lincoln Way, along with the reduction of bicycle parking to 12 qualified bicycle system spaces (6 bike racks) with the following conditions: (1) The use of the worship area will be limited to Wednesday evenings (6:00 p.m. to 11:00 p.m.), based on the terms of the Joint Use Parking Agreement; and (2) All other conditions of approval and terms of use as previously approved with Case No. 21-08. Any person desiring to appeal this decision to a court of record may do so within thirty (30) days after the filing of this decision.
