HomeMy WebLinkAboutDO 1415 SUMMIT AVE CASE NO 22-08 OCT 27 20V CITY OF AMES, I ZONING BOARD OF ADJUSTMENT IN THE MATTER OF THE APPLICATION OF AMES WALDORF ASSOCIATION CASE NO. 22-08 FOR A SPECIAL USE PERMIT FOR PARCEL ID: 05-34-450-170 PRAIRIE FLOWER CHILDREN'S CENTER, AMES MUNICIPAL CODE DECISION & ORDER SECTION 29.1503(4), LOCATED IN THE RESIDENTIAL-LOW DENSITY ZONING DISTRCT AT 1415 SUMMIT AVENUE FACTS This application came before the Board for a Special Use Permit to allow for a daycare center in a house formerly used as a single-family home. The property is located at 1415 Summit Avenue, and it is a single-family home in the urban core residential-low density (RL) zoning district. The property, including the basement, contains 1,991 square feet of space, detached garage and sits on a 6,487 square foot lot. The Ames Waldorf Association has contracted to purchase the home and presented its plans to make interior improvements to the home, including an ADA compatible access ramp in the front yard. The Applicant also intends to ensure that minimum parking requirements are met and plans to pave the driveway. The Applicant indicated that the daycare operations will be Monday through Friday, from 7:30 a.m. to 5:30 p.m., with occasional small meetings and parent gatherings on evenings and weekends. The daycare will also include a preschool program and an afterschool program. The programs will be operated consistent with state requirements. The business currently has two employees who will be on site at the same time. The daycare will serve up to a maximum of twenty children at any given time. Planner Benjamin Campbell presented the Staff Report to the Board and indicated concerns over parking and the harmonious nature of the periods of increased traffic during pick up and drop off times along Summit Avenue in the neighborhood. The Staff Report recommended denial of the request for a Special Use Permit to allow for a daycare center at 1415 Summit Avenue presenting findings that the project did not meet the criteria of Section 29.1503(4). The Applicant attended the meeting and presented oral testimony. The Board accepted and considered the Staff Report, the testimony presented at the hearing, and adopted the Factual Findings and Conclusions in the Staff Report. FINDINGS AND DECISION The Board considered the facts as detailed above and provided in the Staff Report and all evidence provided at the hearing. The Board adopted the findings in the Staff Report and found that the project does not meet the criteria is not consistent with zoning standards as established by the Applicant under Section 29.1503(4) of the Ames City Municipal Code. ORDER WHEREFORE, IT IS ORDERED that pursuant to Section 29.1503(4) of the Ames City Municipal Code, a Special Use Permit for the proposed daycare center at 1415 Summit Avenue is DENIED. Any person desiring to appeal this decision to a court of record may do so within thirty (30) days after the filing of this decision. Done this 13t" day of July 2022.
