FACTS
This application came before the Board for a Special Home Occupation Permit to allow for a
beauty parlor at 1101 Maxwell Avenue. The subject property is a one-story, single-family home
with a full basement in the urban core residential medium density (UCRM) district. The
property, including the basement, has 3,224 square feet of space with a two-car garage with
space for two parking spaces in front of the garage.
The Applicant indicates that the business has no employees outside of the household, no more
than one customer at a time, and typically up to eight customers per day. The beauty parlor will
be in the basement and the customer entrance will be the door on the north side, which leads onto
the staircase to the basement. The basement has a bathroom for customer use. The Applicant
states that the beauty parlor space is 306 square feet, which is 9.5% of the home's total square
footage. The Applicant indicated no signage associated with the business would be erected on
the property. There are no other active home occupation permits currently at this location.
Planner Benjamin Campbell presented the Staff Report to the Board and indicated that staff
determined that the home met all of the applicable criteria for a Special Home Occupation Permit
under the Ames City Code Section 29.1304(3). The Applicant attended the meeting and
presented oral testimony. The Board accepted and considered the Staff Report, the testimony
presented at the hearing, and adopted the Factual Findings and Conclusions in the Staff Report.
FINDINGS AND DECISION
The Board considered the facts as detailed above and provided in the Staff Report and all
evidence provided at the hearing. The Board adopted the findings in the Staff Report and found
that the relevant standards were met and established by the Applicant under Section 29.1304(3)
of the Ames City Municipal Code.
ORDER
WHEREFORE, IT IS ORDERED that pursuant to Section 29.1304 of the Ames City
Municipal Code, a Special Home Occupation Permit is GRANTED to allow for a beauty parlor
at 1101 Maxwell Avenue, subject to the home occupation being operated in a manner consistent
with the findings made by the Board, as set forth in the Staff Report.
Any person desiring to appeal this decision to a court of record may do so within thirty (30) days
after the filing of this decision.
