HomeMy WebLinkAbout~Master - D&O for massage practice at 1509 Grand AvenueCITY OF AMES, IOWA ZONING BOARD OF JUN 2 32022 10 CITY OF AMES, IOWA IN THE MATTER OF THE APPLICATION OF LI HUANG FOR A SPECIAL HOME CASE NO. 22-05 OCCUPATION, AMES MUNICIPAL CODE SECTION 2913.04(1)(b), LOCATED IN THE PARCEL ID: 05-34-479-040 RESIDENTIAL LOW DENSITY ZONING DECISION & ORDER DISTRCT AT 1509 GRAND AVENUE FACTS This application came before the Board for a Special Home Occupation Permit to allow for a massage business in a residential low density zoning district located at 1509 Grand Avenue. The subject property is a one-story, single-family home with a full basement. The property has a detached two -car garage, directly behind the house. The driveway has space for two (2) parking spaces and a turnaround (which enable cars to drive forward onto Grand Avenue instead of backwards). The Applicant indicates that the business has no employees outside of the household and no more than three customer visits per day. One of the three bedrooms will be used for the business enterprise. The Applicant states that the room comprises 13% of the home's square footage, which is less than the maximum allowed under the Code of 25%. The Applicant indicated no signage associated with the business would be erected on the property. There are no other active home occupation permits currently at this location. Planner Benjamin Campbell presented the Staff Report to the Board and indicated that City staff determined that the home met all of the applicable criteria for a Special Home Occupation Permit under the Ames City Code Section 29.1304(3). The Board accepted and considered the Staff Report and the testimony of a witness on behalf of the Applicant. FINDINGS AND DECISION The Board considered the facts as detailed above and provided in the Staff Report and all evidence provided at the hearing. The Board adopted the findings in the Staff Report and found that the relevant standards were met and established by the Applicant under Section 29.1304 of the Ames City Municipal Code. ORDER WHEREFORE, IT IS ORDERED that pursuant to Section 29.1304 of the Ames City Municipal Code, a Special Home Occupation Permit be GRANTED to allow for a massage business at 1509 Grand Avenue, subject to the home occupation being operated in a manner consistent with the findings made by the Board, as set forth in the Staff Report. Any person desiring to appeal this decision to a court of record may do so within thirty (30) days after the filing of this decision.
