HomeMy WebLinkAbout~Master - D&O Special Home Occupation to allow speech language pathology practiceCITY OF AMES, IOWA ZONING BOARD OF MAY T 3 2022 CITY CITY AMES IOWA IN THE MATTER OF THE APPLICATION OF LACEY WOLF FOR A SPECIAL CASE NO. 22-02 HOME OCCUPATION, AMES MUNICIPAL CODE SECTION 2913.04(3), PARCEL ID: OS-32-477-160 LOCATED IN THE RESIDENTIAL LOW DECISION & ORDER DENSITY ZONING DISTRCT AT 3314 CANTERBURY COURT FACTS This application came before the Board for a Special Home Occupation Permit to allow for a speech language pathology practice in a residential low density zoning district located at 3314 Canterbury Court. The Applicants indicate that the business will accept customers Monday through Fridays between the hours of 9:00 a.m. and 4:00 p.m., with most appointments occurring on Tuesdays and Thursdays by appointment only, between the hours of 9:00 a.m. and 1:00 p.m. No more than four (4) clients will come to the home each day the business is open, and the driveway will accommodate up to two (2) parking spaces in front of the garage. There are no active home occupation permits currently at this Iocation. Director of Planning & Housing Kelly Diekmann presented the Staff Report to the Board and indicated that the home occupation falls within the maximum area permitted for such occupation, meets the parking and customer visit allowances of the code, will be Iimited to typical business hours, and will be by appointment only. The proposed use will not alter the normal residential character of the area and staff recommends approval of the Special Home Occupation Permit. FINDINGS AND DECISION The Board considered the facts as detailed above and provided in the Staff Report and all evidence provided at the hearing. The Board adopted the findings in the Staff report and found that the relevant standards were met and established by the Applicant under Section 29.1304(3) of the Ames City Municipal Code. ORDER WHEREFORE, IT IS ORDERED that pursuant to Section 29.1304(3) of the Ames City Municipal Code, a Special Home Occupation Permit be GRANTED to allow for a speech language pathology practice at 3314 Canterbury Court, subject to the home occupation being operated as described by Applicants. Any person desiring to appeal this decision to a court of record may do so within thirty (30) days after the filing of this decision.
