The Zoning Board of Adjustment cannot approve a Special Use Permit unless all of the "General Standards"and the "Commercial Zone Standards" are met. In order to facilitate review of this application for a Special Use Permit, the applicant must address each of the "General Standards", set forth in Section 29.1503, and in addition, the "Commercial Zone Standards", set forth in Section 29.1503(4)(c) of the Zoning Ordinance. (Note: The applicant's explanation of how the request meets each standard may be attached on a separate sheet if sufficient space is not provided.) 1. General Standards. The Planning and Zoning Commission and the Zoning Board of Adjustment shall review each application for the purpose of determining that each proposed use meets the following "General Standards`, set forth in 29.1503(4)(a), and in addition, shall find adequate evidence that each use in its proposed location will: (a) Be harmonious with and in accordance with the general principles and proposals of the Land Use Policy Plan (LUPP). Explain how the request meets this standard. The site is currently undevoloped property. Houses that had occupied the property were demolished by the previous owner. The business will have a new building and site Improvements. The existing buslnoss to the west Is a bank,to the south HOC zoned residential(owned by this business), to the east a converted motel to residential,and across Lincoln Way(an arterial street)there are automotive repair and sales, and the City's Resource Recovery Plant. 4 Application Form Last Updated: August 8, 2017 (c) Not be hazardous or disturbing to existing or future uses in the same general vicinity. Explain how the request meets this standard. The dry cleaning process used by this process is environmentally safe. All cleaning material is recovered and reused. The use of perchloroetheylene (commonly referred to as"perc")is NOT used in this cleaning process. The cleaning is not hazardous or disturbing to future uses In the same general vicinity. (d) Be served adequately by essential public facilities and services such as highways, streets, police, fire protection, drainage structure, refuse disposal, water and sewage facilities, and/or schools. Explain how the request meets this standard. The business is located on an arterial street. It is adequately served by police,fire,water, sewer, drainage, refuse. The facility does not impact the schools. (e) Not create excessive additional requirements at public cost for public facilities and services. Explain how the request meets this standard. This business Is redeveloping unused property. The cleaning process is closed loop system and there is no contact with chemicals.The process is NOT detrimental to any person,property or the general welfare. The site is located on an arterial street that Is Intended to serve heavy traffic;the entrance to the facility is on a side street and the exit Is on the side street and alley. There Is no noise,smoke,fumes,glares or odors. (g) Be consistent with the Intent and purpose of the Zone In which It is proposed to locate such use. Explain how the request meets this standard. The existing zone is Highway Oriented Commercial. The dry cleaning business is a service business that Is appropriate for HOC. The business needs to be located where it is conveinant for the customers to easily access the property on frequent basis. This site fulfills those needs of the business and the HOC zone. 6 Application Form last Updated:August S,2017 2. Commercial Zone Standards. The Planning and Zoning Commission and the Zoning Board of Adjustment shall review each application for the purpose of determining that each proposed use in a commercial zone meets the "Commercial Zone Standards", set forth in 29.1503(4)(c), which are listed below, and shall find adequate evidence that each use in its proposed location will: (a) Be compatible with the potential commercial development and use of property planned to occur in the area. Explain how the request meets this standard. It is not expected there will be any redevelopment of the bank to the west or the hotellresidence to the east. The area to the south may be expanded In the future if the cleaning business Is expanded or additional services are offered. Redevelopment of adjacent parcels are likely with the relocation of businesses forced out of Lincoln Way by the new zoning regulations. (b) Represent the sufficiently desirable need for the entire community that the loss of commercial land is Justifiable In relation to the benefit. Explain how the request meets this standard. A dry cleaning facility Is a desirable service for the community's needs. Mayfair is currently the only operating facility in Ames. Other business that offer dry cleaning are shipping the Items to out of town facilities. The amount of land used for thls development is very small;0.31 acre. They are relocating from their existing facility on Lincoln Way that is too small and has traffic congestion issues. Their current site is rented and likely to be redeveloped in the future. (c) Be consistent with all other applicable standards in the zone. Explain how the request meets this standard. The business is consistent with all applicable standards in the HOC zone. Section 29.1500(2)(d)(iii) of the Zoning Ordinance, requires that notice shall be posted by the City on the subject property. One notice sign shall be posted for each property. Required signs shall be posted along the perimeter of the subject property in locations that are highly visible from adjacent public streets prior to the public hearing. The owner of property at hereby grants the City of Ames permission to place "Zoning Action Pending"signs on the property for the purpose of informing interested persons of the request for action by the City of Ames.
