IO%VA OF BRUCE RUNNER, AS TRUSTEE, FOR CASE NO. 21-12 A VARIANCE, UNDER MUNCIPAL CODE §29.1504, FOR THE PROPERTY GEOCODE NO. 09-02-200-040 LOCATED AT 1227 CARROLL AVENUE, IN THE UCRM ZONING DISTRICT DECISION & ORDER FACTS AND CONCLUSIONS Applicant Bruce Runner, as Trustee, brought this application for Variance to allow the construction of a detached garage in the front yard of the property located at 1227 Carroll Avenue (legally known as "The East 50 feet of Lot 3, except the South 66 feet thereof, Emery's Subdivision, Ames, Story County, Iowa. "). The zoning classification for the property is UCRM and has a small single-family home on the property. A one-car garage used to exist on the site and was recently demolished; the Applicant seeks to construct a 24' x 36' (864 sq. ft) structure on the property to use as a two-car detached garage with a driveway matching the width of the garage door and meeting the driveway standards of the Zoning Ordinance (Ch. 29). The Applicant's plans require a variance to allow a reduction of the minimum rear year setback from 20 feet to 3 feet, and a reduction of the minimum front yard setback from 25 feet to 23 feet. See Table 29.703(3). City Planner Julie Gould presented the application and Staff Report to the Board. The owner of a neighboring property, Sam Shonkwiler, spoke in favor of the Applicant's request for a variance to allow for the construction of the proposed garage. The Board accepted both the Staff Report and testimony as evidence. The Board noted that the Staff Report found that all criteria needed to approve the variance were adequately satisfied and made findings consistent with the Staff Report. The variance is limited to the structure identified in the plans prepared by Mr. Runner in his application. DECISION The Board considered the facts as detailed above and found that the relevant standards in Section 29.1504 were met and established by the Applicant. ORDER WHEREFORE, IT IS ORDERED that the variance of the front and rear yard setbacks in Table 29.703(3) is APPROVED, pursuant to Ames Municipal Code Section 29.1504 of the Ames Municipal Code, to allow for the construction of a detached two-stall garage (approximately 864 square feet) upon the -property at 1227 Carroll Avenue, as follows: (1) a reduction in the 2 minimum required rear-yard setback from 20 feet to approximately three feet; and (2) a reduction of the minimum front-yard setback from 25 feet to approximately 23 feet.
