CASE NO. 21-10 GRANDON OF CONTINUE CARE REAL ESTATE HOLDINGS LLC, FOR PARCEL ID: 09-I1-101-075 VARIANCE, SECTION 29,1504 OF THE AMES MUNICIPAL CODE, TO ALLOW A DECISION & ORDER WALL SIGN IN THE S-SMD ZONING DISTRICT AT 119 WASHINGTON AVENUE FACTS City Planner Ray Anderson presented the application for a Variance to allow a wall sign on a building with no street frontage in the South Lincoln Sub Area Mixed Use District at 119 Washington Avenue to the board. The property was recently converted from an auto repair business to a banquet hall.The banquet hall is intended to serve as a place where family and friends can gather following funeral services at Grandon Funeral and Cremation Care directly across the alley, and as a venue for other occasions. I The property is located in the "S-SMD" (South Lincoln Sub Area Mixed-Use District) which allows one wall sign per street frontage. However, this property does not abut a public street. It does abut an alley on the north and west sides; however, an alley is not included in the definition of"street" in the zoning ordinance. Therefore, a wall sign is not allowed since there is no frontage on a street. Planner Anderson stated this is a unique case as most places have street frontage. Applicant Timothy Grandon testified that the property at issue is the only interior lot in the district. Applicant Grandon stated that about 60 feet of signage to the north, west, and east faces of the building have been removed. The sign that the Applicant wants to install is to assist the Fire and Police Departments in locating the building in the event of an emergency. No member of the public commented on the application either at the hearing. As part of the Applicant's variance request, the Board did receive an Adjoining Property Owner Statement that was signed by several adjoining property owners indicating no objections to a 2' x 9' wall sign on the north side of the building at 119 Washington Avenue. FINDINGS & DECISION The Board considered the facts as detailed above and provided in the staff report, and all testimony given at the hearing. The Board adopted the findings in the staff report and found that all the relevant standards in Section 29.1504(4) were satisfied by the Applicant. 2 ORDER WHEREFORE,IT IS ORDERED that the Applicant is GRANTED,pursuant to Section 29.1504_ of the Ames Municipal Code, a Variance for a wall sign in the S-SMD Zoning District at 119 Washington Avenue. Any person desiring to appeal this decision to a court of record may do so within 30 days after the filing of this decision.
