IOWA' GEOCODE NO. 09-05-476-075 DECISION & ORDER Since December 2019, the Lutheran Church of Hope has owned the property at 3329 Lincoln Way. The property has one building and associated parking and is zoned Highway Oriented Commercial (HOC). It is nonconforming to setbacks, landscaping and other related zoning standards. Until recently, there was an existing tenant on the north side of the building that operated a laundromat. The lease has expired and the Church seeks to reconfigure the space and enlarge the religious institution use occupying the structure. The Board previously granted a special use permit to operate weekly religious services within the 2,900 square feet of the building. This request is to extend the religious institution use throughout i the entire 6,500 square foot building, which is a conversion of approximately 3,600 square feet previously occupied by the Laundromat. Planner Eloise Sahlstrom reviewed the Staff Report before the Board and testimony was heard from a representative of the Church. Planner Sahlstrom identified four conditions for approval that were recommended by the. Staff and the Church indicated its acceptance of the proposed conditions. DECISION The Board considered the facts as detailed above and provided in the staff report and found that the relevant standards in Section 29.1503(4) were met and established by the Applicant. WHEREFORE, IT IS ORDERED that the Applicant is GRANTED, pursuant to Section 29.1503 of the Ames Municipal Code, a Special Use Permit to expand the religious institution use within the structure at 3329 Lincoln Way over the entire 6,500 square foot of the building with the following conditions: (1) The sidewalk along Colorado Avenue frontage through the drives requires detectable warning panels on both sides of each driveway. (2) The sidewalk connection to the ramp at the northwest corner of Lincoln Way and Colorado must meet City ramp standards, and if it is not, the Applicant shall remove part or all of the existing ramp to make a compliant connection. (3) The proposed sidewalk from Colorado Avenue is illustrated as crossing onto the Applicant's property in order to align with the grade of Lincoln Way sidewalk. When making this connection, portions of the sidewalk that cross private property require a pedestrian easement that shall be the responsibility of the Applicant. (4) Remove compacted material in areas where pavement is proposed to be removed for new landscape areas. New soil which meets organic content requirements of the City must be used as backfill in these areas. Any person desiring to appeal this decision to a court of record may do so within 30 days after the filing of this decision. Done this 23`d day of June 2021.
