Riverside DriveI ?1 IN THE MATTER OF THE APPLICATION OF DAVID AND MICHELE EVANS, FOR CASE NO.20-14 A SPECIAL USE PERMIT, SECTION 29.1503 OF THE AMES MUNICIPAL G.EOCODE NO. 09-10-1.26-090 CODE, FOR GUEST LODGING TO ALLOW A VACATION LODGING USE IN DECISION & ORDER. THE UCRM ZONING DISTRICT AT 207 S. RIVERSIDE DRIVE FACTS Planner Benjamin Campbell presented the application for a Special Use Permit to the Board. Applicants David and Michele Evans are the owners of a property located at 207 S. Riverside Drive. This structure is a single-family detached dwelling located within the "UCRM" Urban Core Residential Medium Density Zoning District. Applicants seek a SLIP for the purpose of using the two -bedroom house as Vacation Lodging. Planner Campbell presented the staff report and findings and noted that Vacation Lodging is a. use that would allow use of the property for guest stays of up to 31 days without the property owner being present. He further noted that the property must also be registered as a rental property consistent with the standards of the Agnes Municipal Code. Applicants David and Michele Evans are requesting approval of a two -bedroom dwelling with two of the bedrooms available for Guest Lodging and with four adults as guests. The request for four adults is not consistent with the occupancy standards allowed in the .Acmes Municipal Code. Approval of this request requires a stipulation noting the occupancy limitations of the Municipal Code; in this case three adult guests for a two -bedroom home is the maximum permitted. The property includes a one -car attached garage and allows for three additional stacked driveway parking spaces that meet the minimum dimensions, The driveway is paved. The recent zoning Ordinance revisions allow stacked parking to count toward the minimum parking requirement. The satisfies the Guest Lodging Code requirement which requires one parking space per bedroom. Although there are no specific zoning separation requirements in the Zoning Ordinance, there is a 1,000-foot separation distance applied during review of the license application. At this time, there are no licensed Vacation Lodging single-family or two-family properties within 1000-feet of the applicant. The property has a four-year Letter of Compliance that was issued on August 15, 2019, and will expire on August 15, 2023. In accordance with their findings in the Staff Report, Staff concluded that the proposed Vacation Lodging use met the requirements for a Special Use Permit for Guest Lodging and with the general and specific residential standards required for granting a Special Use Permit. Staff also 2 concluded that the proposed Vacation Lodging use could operate in a manner compatible with the surrounding uses and not cause a nuisance to the surrounding neighbors. Notification was made to all homes within 2004'eet. No complaints were received. Applicant David Evans testified that it is important to him and his wife to have hannoniouS relationships with the neighbors. Neighbors have the Applicant's phone number and are encouraged to call if there are any issues, The Board clarified for Mr. Evans that the maximum number of adults that can stay in the home is three, but there is no maximum number for children. Neighbor Glenn Wiedenhoeft testified in support of the Applicants and stated that they have taken better care of the home than the previous owners. nVClgrnN The Board considered the facts as detailed above and as provided in the staff report as amended, and found that all of the relevant standards in Section 29.1503 were met and established by the Applicant. � r WHEREFORE, IT IS ORDERED that the Applicant is GRANTED, pursuant to Section 29.1503 of the Ames Municipal Cade, a. Special Use Permit for Guest Lodging to allow a Vacation Lodging use in the UCRM Zoning District at 207 S. Riverside Drive, with the following requirements: 1. Two off-street paved parking spaces required. 2. Maximum of two guest bedrooms allowed. 3. Maximum of three adult guests allowed. 4. One year of disuse will render this Special Use Pen -nit expired and void. 5. The Special Use Permit is not transferrable to any subsequent owner of the property. Any person desiring to appeal this decision to a court of record may do so within 30 days after the filing of this decision.
