Section 29.1307(4) of the Zoning Ordinance states that A cell site with antenna that is either not mounted on an existing tall structure or constitutes a Substantial Change shall not be permitted except pursuant to a Special Use Permit issued by the Zoning Board of Adjustment pursuant to both Section 29.1503 and the provisions of this Section. Upon receipt of an application for construction of a new tower to the City, the Zoning Board of Adjustment has 150 days to act upon said application. If the application is for a substantial change of an existing structure the Zoning Board of adjustment has 90 days to act upon said application. Such a cell site with antenna shall not be permitted except pursuant to a Special Use Permit issued by the Zoning Board of Adjustment in accordance with Sections 29.1503 and 29.1307. The Zoning Board of Adjustment cannot approve a Special Use Permit unless all of the "General Standards" and the "Cell Site with Antenna" standards are met. In order to facilitate review of this application for a Special Use Permit, the applicant must address each of the "General Standards" set forth in Section 29.1503, and in addition, the standards for a "Cell Site with Antenna"set forth in Section 29.1307(8) of the Zoning Ordinance. (Note: The applicant's explanation of how the request meets each standard may be attached on a separate sheet if sufficient space is not provided.) 1. General Standards. The Planning and Zoning Commission and the Zoning Board of Adjustment shall review each application for the purpose of determining that each proposed use meets the following standards, set forth in 29.1503(4)(a), and in addition, shall find adequate evidence that each use in its proposed location will: (a) Be harmonious with and in accordance with the general principles and proposals of the Land Use Policy Plan (LUPP). Explain how the request meets this standard. The tower to serve the area has a stealth design with all the antennas concealed in canisters and a light standard was added as well 5 Application Form Last Updated: March 6. 2019 (b) Be designed, constructed, operated, and maintained so as to be harmonious in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the area in which it is proposed. Explain how the request meets this standard. The tower has stealth canisters to conceal equipment and is light colored to not stand out. There is also extensive landscaping planted to conceal the ground equipment from view as well as blend into the surrounding trees. (c) Not be hazardous or disturbing to existing or future uses in the same general vicinity. Explain how the request meets this standard. There are no hazardous materials kept on site and this is an unmanned facility so there is minimal activity at this location (d) Be served adequately by essential public facilities and services such as highways, streets, police, fire protection, drainage structure, refuse disposal, water and sewage facilities, and/or schools. Explain how the request meets this standard. There are no waste products produces at this facility. There is no water service or sewage requirements. The majority of the leased parcel consists of permeable material therefore drainage is unaffected by the improvements at this location. 6 Application Form Last Updn+,,;+ a ''n'19 (e) Not create excessive additional requirements at public cost for public facilities and services. Explain how the request meets this standard. This facility does not create any additional cost for the public and in reality actually adds to the infrastructure of the City by facilitating a way for people to reach emergency services by adding to cellular coverage in the City. (f) Not involve uses, activities, processes, materials, equipment, or conditions of operation that will be detrimental to any person, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare, or odors. Explain how the request meets this standard. There are no activities or materials within this leased area that pose any public threat. This facility is a RF transmit tower and emits no noise. smoke, fumes, glare or odor. This is an unmanned facility that will not generate any additional traffic in the area. (g) Be consistent with the intent and purpose of the Zone in which it is proposed to locate such use. Explain how the request meets this standard. This facility is consistent with the Zone it is located in by the fact that it is heavily landscaped with trees and shrubs to conceal the ground equipment and all required stealth panels are present. It is similar in fashion and design to a light pole and is located in an area where the public uses cellular devices to communicate. 7 Application Form Last Updated: March 6. 2019 2. Standards for a Cell Site with Antenna: City staff shall review each administrative application for the purpose of determining that the following standards, set forth in 29.1307(8), which are listed below, have been met. (a) Tower Height. The applicant shall demonstrate, to the reasonable satisfaction of city staff that the antenna is the minimum height required to function satisfactorily. No antenna or tower shall be constructe4d, altered, or maintained so as to project above any of the imaginary airspace surfaces described in FAR Part 77 of the FAA guidance on airspace protection. Explain how the request meets this standard. This is an existing structure that has previously received FAA approvals. The original FAA determination approved a 125' tower. This tower is actually only 120'. There is no change to the height of this existing structure and therefore poses no risk to aviation traffic. (b) Setbacks from Base of Tower. The minimum distance between the base of the support or any guy anchors and any property line shall be equal to 50% of the antenna height. Explain how the request meets this standard. The tower is situated on the parcel to sit 147' from the North property line, 168' from the South property line, 137' from the West property line and 60' from the East property line. Which falls within the 50% of tower height requirement. (c) Antenna Support Structure Safety. The applicant shall demonstrate, to the reasonable satisfaction of city staff that the proposed antenna and support structure are safe and the surrounding areas will not be negatively affected by support structure failure, falling ice or other debris, or radio frequency interference. All support structures shall be fitted with anti-climbing devices, as approved by the manufacturers. Explain how the request meets this standard. There are no external appurtences to collect ice so falling debris is not an issue, all radio frequencies are licensed and owned by the applicant which eliminates RF interference, The tower structure is a featureless pole with no provision to climb. Anti Climbing devices are not applicable here as there is no way to climb the tower. The compound is also fenced and locked to deter unauthorized access to the tower. 8 Application Form Last Updated: March 6. 2019 (d) Screening. Appropriate screening shall be installed composed of wood, masonry material or other substantial materials. Landscaping may also be required. Explain how the request meets this standard. Facility has an existing wood fence and substantial mature trees and shrubs to screen the facility from view. (e) Painting and Visual aesthetics. The design of towers, antennas and base stations should minimize the adverse visual impact of the facility through siting, landscape screening, and stealth techniques. (i) Towers shall either maintain a galvanized steel finish (dull gray or white) or, subject to any applicable standards of the FAA, be painted a neutral color so as to reduce visual obtrusiveness to the maximum extent possible. (ii) The design of the base station and related structures shall, to the maximum extent possible, use materials, colors, textures, screening, and landscaping that will blend them into the natural setting and surrounding buildings. (iii) The wireless facility shall be designed to complement the physical landscape in which they are intended to be located. Examples of stealth techniques that may be compatible include but are not limited to faux trees, unipoles/slick sticks, bell towers, etc. New stealth towers shall be configured and located in a manner that shall minimize adverse effects including visual impacts on the landscape and adjacent properties. New freestanding structures shall be designed to be compatible with adjacent structures and landscapes with specific design considerations such as architectural designs, scale, color and texture. (iv) Conduit or cable must be concealed on towers with externally mounted equipment. (v) The use of internally mounted or flush mounted technology is encouraged when adjacent to residential areas, prominent commercial areas and prominent entryways to the city. Support structures 200 feet in height or taller, or those near airports, shall meet all Federal Aviation Administration regulations. Explain how the request meets this standard. Structure is already approved by the FAA certificate is included in documentation for reference (h) Separation Requirements. Towers exceeding 50 feet in height, except those incorporating stealth techniques, shall be placed at minimum one quarter mile apart. Wireless facilities in rights-of-way are not subject to separation requirements. Explain how the request meets this standard. There are no wireless towers within 1/4 mile of this structure. The basic criteria for designing a monopole such as wind speed, effective areas of monopole sections, factored resistances, allowable rigidity and foundation requirements are based on ANSI/TIA Standard 222-G. A monopole is treated as a cantilevered beam with a fixed base support. Wind, ice and weight are the major design loads considered in the static analysis. Effects due to eccentric moments, torques, slopes and deflections are included in the computer program. After all the necessary input data is entered, the program will compute the effective area of each monopole section, the wind loads at each elevation, and the factored resistance of each section. The factored loads are then compared with the factored resistances to determine the adequacy and/or required sizes. Expansion of Permitted Use. Landlord hereby agrees that Tenant shall have the right, without the requirement of obtaining Landlord's consent, to modify, supplement, replace, upgrade, expand or refurbish the equipment related to Tenant's communications facility (the "Communications Facility"), increase the number of antennas thereon or relocate the Communications Facility within the Premises or install, operate and maintain a back-up emergency generator on the Premises at any time during the term or any renewal term of this Lease. Landlord shall cooperate with Tenant in all respects in connection with the foregoing. If Landlord does not comply with the terms of this Section, Tenant may exercise all of its rights and remedies under law or equity, including, without limitation, terminating this Lease,and upon such termination, Tenant shall have no further liability to Landlord. 2. Expansion of the Premises. Landlord grants Tenant the right, to the extent practicable and on a space available basis, to enlarge the Premises (the "Additional Premises"), so that Tenant may implement any necessary modifications, supplements, replacements, refurbishments, or expansions to the Communications Facility or to any equipment related thereto, as determined by Tenant in its sole discretion. The Additional Premises square footage will not exceed an area equal to the current square footage of the Premises, for space contiguous or adjacent to the Premises in a location and configuration to be designated by Tenant and reasonably approved by Landlord, which approval shall not be unreasonably withheld, conditioned or delayed. If Landlord does not respond within thirty (30) business days following Tenant's request for approval, then Landlord's approval shall be deemed granted. In the event Tenant requires Additional Premises for such purposes, the monthly Base Rent payable for such Additional Premises shall be the lesser of(i) the then current Base Rent calculated on a square foot basis or (ii) the amount of (the "Additional Premises Rent"). The Additional Premises Rent shall be compensation for space utilized by the expansion of Tenant's room/cabinet/ground area and for expansion of the antenna area(s) beyond the Premises, but Tenant's addition of coaxial cables, raceways, conduits and other ancillary equipment and such related space usage, shall not require or result in Additional Premises Rent or any other compensation to Landlord. The Additional Premises Rent shall be payable to Landlord at the times and in the manner set forth in this Lease for payment of Base Rent and shall be subject to adjustment from time to time in the same manner set forth in this Lease for adjustments to Base Rent. Landlord agrees to take such actions and enter into and deliver to Tenant such documents as Tenant reasonably requests in order to affect and memorialize the lease of the Additional Premises to Tenant. Landlord and Tenant agree that each and every reference in this Lease to the "Premises" shall also include the "Additional Premises" (if any). 3. Right of First Refusal. Tenant (or its successor in interest, assignee or designee) shall have and Landlord hereby grants to Tenant a right of first refusal ("Right of First Refusal") to purchase (a) any easement rights in or over all or any part of the Premises; or (b) all or any part of Landlord's interest in or rights under this Lease (each, "Landlord's Interest") whenever Landlord receives and desires to accept a bona fide offer from an unrelated third party to purchase Landlord's Interest("Offer"). Prior to accepting such Offer, Landlord shall give Tenant a copy of the Offer and other relevant documents, including the price and the terms and conditions upon which Landlord proposes to transfer Landlord's Interest(collectively, the"Right of First Refusal Notice"). Tenant shall have thirty (30) days from the receipt of such notice to agree to purchase Landlord's Interest for the price and upon the terms and conditions specified in the Offer ("Tenant Approval Period"). Upon Tenant's delivery to Landlord of an Acceptance Notice, Landlord and Tenant shall, within thirty (30) days after such delivery, cooperate to enter into a mutually acceptable purchase and sale agreement pertaining to such Landlord's Interest (the "Purchase and Sale Agreement"), which shall contain the terms of the Offer as well as customary provisions contained in similar agreements entered into in the metropolitan area in which the Property is located. If Tenant does not exercise the Right of First Refusal during the Tenant Approval Period, then Landlord may proceed to transfer Landlord's Interest upon the same terms and conditions set forth in the Offer; provided such transfer occurs within six(6) months following the date of the Right of First Refusal Notice and is made in accordance with the provisions of this Lease. The Right of First Refusal shall be an on-going right during the lease term. Tenant's failure to exercise or waiver of its Right of First Refusal in any instance shall not be deemed a waiver of Tenant's Right of First Refusal for subsequent Offers. Except as provided above, Landlord's rights to transfer any part of the Premises or Property shall not be encumbered or restricted. This Right of First Refusal shall not apply to a sale of Landlord's entire fee interest in the Property. 4. Landlord's Insurance. Landlord shall maintain general liability insurance insuring against liability for bodily injury, death or damage to personal property with combined single limits of One Million and No/100 Dollars ($1,000,000).
