This appeal will not be granted unless sufficient facts are presented in this application to justify the variance in light of the standards and to show that the granting of the variance relates to the intent and purposes of the Zoning Ordinance and the Land Use Policy Plan. Approval of the Variance by the Zoning Board of Adjustment in no way absolves the applicant from subsequently obtaining the necessary building permits or other permits from the City of Ames or from other applicable agencies. In order to facilitate review of this application for a Variance, the applicant must address each of the "Variance Standards" set forth in Section 29.1504(4) of the Zoning Ordinance, which are listed below. (Note: The applicant's explanation of how the request meets each standard may be attached on a separate sheet if sufficient space is not provided.) 1. Variance Standards. The Zoning Board of Adjustment shall review each application for the purpose of determining that the "Variance Standards" are satisfied. Pursuant to Iowa law, a variance shall be granted only if all of the following standards are satisfied: (a) The granting of the variance shall not be contrary to the public interest. The Site Plan shall be a reproducible, black line drawing on a sheet of paper no larger than 11"x17". If the project for which the Variance is sought is a single- family or a two-family dwelling, or other use exempt from the requirement for a "Site Development Plan", then the Site Plan shall include, at a minimum, the following information: (NOTE: If the proposed project requires approval of a "Major or Minor Site Development Plan", it should be included with this application for a "Variance", not the Site Plan described on this checklist.) One notice sign shall be posted for each property. Required signs shall be posted along the perimeter of the subject property in locations that are highly visible from adjacent public streets prior to the public hearing. In other words because this particular property resides on a curve or corner per se it is seen as having two front yards. Two front yards per code but visually only one front yard. Code says you can't add parking to the front yard. The purpose of this request is ideally for functionality and safety. As we all know parallel parking and/or backing out onto a street increases the chances of an accident. The undue requirements to shuffle cars means that any time someone wants to drive off the property and they have a car behind them; they will have to: A. drive on the lawn and damage the lawn (especially in wet conditions) B. move the other car first. This means having to move two cars every time the front car wants to leave. A. Aesthetically I think it is fair to say, this would create nothing in the way of"unattractive or aesthetically unpleasant". It would simply blend right in and be consistent w/every other home in the area. Many homes (including the adjacent neighbor) have parking which in an area that would be considered front yard. B. The setting and topography of 2030 Country Club actually would be enhanced and improved by allowing the parking to be closer to the back of the house and on the side of the house. C. In the end; we are simply requesting to have two approved parking spaces on what is the side of the house and asking that the code be amended or modified to account for houses/properties that reside on curves and corners. D. Please see the visuals and I think you will find it reasonable, rational and logical to allow this change and make this amendment. E. Lastly, no one is arguing what is the side of the house; only what is the side yard vs front yard as it pertains to "approved parking space". For rental purposes,you may submit a Code Modification Application (attached)to allow the current non-compliant parking(because it lacks proper width)to be counted towards the two required off-street parking spaces since site conditions prohibit you from being able to add additional compliant parking. If you would like to add another'lane'of parking to the existing parking,you would be required to also add parking behind the front yard (the Southeast comer of the house). If you would like to request a variance to allow the additional lane without the required rear parking, you may do so here: https://www.cityofames.org/home/showdocument?id=35851. If you feel that the ordinance should be amended so that the front yard is measured from the front plane of the house instead of the closest point to the property line, you may email the City Council(at amescitycouncil@cityofames.org)to request a text amendment. In this email, I would include pictures of the area,a drawing of what you would propose to construct,and the code language that should be amended.The code section to be referenced is 29.406(7)(g): (b) As used in this section, front yard means the open space in that portion of a yard between the street and the face of the structure and a line originating from the left side of the lot and extending to the right side of the lot. The line,as viewed from the street, shall extend parallel to the street to the nearest corner of the principal structure and then along the face of the principal structure to the right corner, and from that point on a line parallel to the street to a point on the right lot line. As used in this section, the face of a principal structure shall be any and all portions of the structure fronting on a street.
