IOWA IN THE MATTER OF THE APPLICATION OF CHAD WILLIAMS, ON BEHALF OF CASE NO. 18-13 NLA AMES, LLC, FOR A SPECIAL USE PERMIT, SECTION 29.1503 OF THE GEOCODE NO.09-11-375-150 AMES MUNICIPAL CODE, TO ALLOW AN INTERIOR CLIMATE CONTROLLED DECISION & ORDER MINI -STORAGE WAREHOUSE FACILITY IN THE HIGHWAY - ORIENTED COMMERCIAL ZONE LOCATED AT 1405 BUCKEYE AVENUE FACTS Applicant NLA Ames, LLC seeks a Special Use Permit to retrofit the rear portion of the existing building at 1405 Buckeye Avenue (formerly the "KMart") into a two-story interior climate controlled mini -storage facility.' The subject property is located within the Highway -Oriented Commercial Zone (HOC). As set forth in Ames Municipal Code Table 29.804(2), the proposed use in the HOC zone requires the issuance of a Special Use Permit under the criteria enumerated in sections 29.1503 and 29.1308. The proposed use is just one part of a redevelopment plan for the entire site which includes nine lots, retrofitting the existing building into five tenants and constructing three new commercial buildings for multiple tenants. Two additional lots (1404 and 1410 Buckeye Avenue) are also part of the proposed development with two additional commercial buildings. The overall site plan and layout was reviewed by City Council as an Integrated Site Plan was approved at its November 13, 2018, meeting. Both the Staff Report submitted to the Zoning Board of Adjustment and the approved Integrated Site Plan are incorporated by reference in these findings of fact. Following the presentation by Staff of its report to the Board and testimony provided by Chad Williams on behalf of the applicant, the Zoning Board of Adjustment adopted the findings of the Staff Report with several amendments. Amendments were made to the findings under General Standards, specifically subsection (vii), and the Commercial Zone Standards, (i) and (ii). DECISION The Board considered the facts as detailed above and provided in the Staff Report, and found that all of the relevant standards were met and established by the Applicant. The portion proposed is 46,000 square feet and approximately 38% of the original structure.
