Special Use Permit
Supporting Information for a Proposed Use
in a Zone other than Residential or Commercial
(This form must be filled out completely before your application will be accepted.)
The Zoning Board of Adjustment cannot approve a Special Use Permit unless all of the
"General Standards"are met. In order to facilitate review of this application for a Special Use
Permit, the applicant must address each of the "General Standards", set forth in Section
29.1503(4)(a) of the Zoning Ordinance.
(Note: The applicant's explanation of how the request meets each standard may be attached
on a separate sheet if sufficient space is not provided.)
1. General Standards. The Planning and Zoning Commission and the Zoning Board of
Adjustment shall review each application for the purpose of determining that each proposed
use meets the following "General Standards", set forth in 29.1503(4)(a), and in addition,
shall find adequate evidence that each use in its proposed location will:
a. Be harmonious with and in accordance with the general principles and
proposals of the Land Use Policy Plan (LUPP).

The zoning & business use are both consistant with the land use policy plan. The
business use if approved is a permitted use within the zoning district. The sole
purpose for the special use permit is because of the size of the building.
b. Be designed, constructed, operated and maintained so as to be
harmonious in appearance with the existing or intended character of the
general vicinity and that such use will not change the essential character of
the area in which it is proposed.
Explain how the request meets this standard.
We believe this is one of the nicest buildings on East Lincoln Way both in
appearance and how the business will be operated. The equipment that is sometimes
displayed out front along East Lincoln Way is brought inside at night. All of the
service work is done inside the building. The Penske rental trucks are kept behind the
building whenever possible.

c. Not be hazardous or disturbing to existing or future uses in the same
general vicinity.
Explain how the request meets this standard.
This is an industrial zone. The operation of this business will not have any impact on
the surrounding properties as most of the activities are contained within the building.
This is probably one of the least intrusive uses possible in an industrial zone.
d. Be served adequately by essential public facilities and services such as
highways, streets, police, fire protection, drainage structure, refuse
disposal, water and sewage facilities, and/or schools.

The building was constructed to all applicable city codes at no additional cost to the city.
The property has an approved site plan conforming with all applicable city codes and
zoning ordinances for a building of this type within the zone. The site is adequately served
by the existing city infrastructure.
e. Not create excessive additional requirements at public cost for public
facilities and services.

This project does not create any additional public costs that I can find.

f. Not involve uses, activities, processes, materials, equipment or conditions
of operation that will be detrimental to any person, property or general
welfare by reason of excessive production of traffic, noise, smoke, fumes,
glare, or odors.
Explain how the request meets this standard.
This project does not involve any activities or processes that would have an adverse
on any person, property or the general welfare. The building does have a sand interceptor
in the shop area as required for a floor drain in a work area. That keeps the sand and
other materials from getting into the sanitary sewer system. There is also a separate
HVAC system for the shop area to deal with any smoke or fumes generated by the service
department.
g. Be consistent with the intent and purpose of the Zone in which it is
proposed to locate such use.

This type of business operation is a permitted use within the General Industrial zone.
The only reason this issue is in front of you for a special use permit is because of the
amount of space being used by this particular Tenant. The fact that there is only one
Tenant in the building also minimizes the impact on the entire area.
