The Zoning Board of Adjustment cannot approve a Special Use Permit unless all of the "General Standards"are met. In order to facilitate review of this application for a Special Use Permit, the applicant must address each of the "General Standards", set forth in Section 29.1503(4)(a) of the Zoning Ordinance. (Note: The applicant's explanation of how the request meets each standard may be attached on a separate sheet if sufficient space is not provided.) 1. General Standards. The Planning and Zoning Commission and the Zoning Board of Adjustment shall review each application for the purpose of determining that each proposed use meets the following "General Standards'; set forth in 29.1503(4)(a), and in addition, shall find adequate evidence that each use in its proposed location will: a. Be harmonious with and in accordance with the general principles and proposals of the Land Use Policy Plan (LUPP). Explain how the request meets this standard. See attached explanation sheet b. Be designed, constructed, operated and maintained so as to be harmonious in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the area in which it is proposed. See attached explanation sheet 6 Application Form Last Updated:August 8,2017 Special Use Permit (Proposed Use in a Zone other than Residential or Commercial) Permission to Place a "Zoning Action Pending" Sign on Private Property (This form must be filled out completely before your application will be accepted.) Section 29.1500(2)(d)(iii) of the Zoning Ordinance, requires that notice shall be posted by the City on the subject property. One notice sign shall be posted for each property. Required signs shall be posted along the perimeter of the subject property in locations that are highly visible from adjacent public streets prior to the public hearing. The owner of property at 210 & 400 Freel Drive hereby grants the City of Ames permission to place "Zoning Action Pending"signs on the property for the purpose of informing interested persons of the request for action by the City of Ames. 1 understand that the signs will be placed on the property several days prior to action on the request by the Planning and Zoning Commission, Zoning Board of Adjustment, or the City Council, and may remain on the property until the request has been approved or denied by the City. General a. Be harmonious with and in accordance with the general principles and proposals of the Land Use Policy Plan (LUPP). The 400 Freel Drive Site will be used as a seasonal yard waste/brush/tree collection and transfer site operated by Chamness Technology under contract with the City of Ames for those services to area residents. Both the 210 and 400 Free[ Drive sites are zoned as General Industrial. The 400 Free[ Drive Site is currently operating under Special Use Permit 17-07 and Flood Plain development Permit# FLOOD-188. The 210 Free[ Drive site was previously under an approved Special Use Permit as a Yard Waste Site per the owner. Surrounding properties/businesses are in the recycling/salvage/waste management or landscape business. 400 Freel Drive will be the collection site and all collected materials are shielded from view by trees, berms or business structures. 210 Freel Drive will only be used on City of Ames designated "Free Days"to permit traffic to egress from 400 Free[ Drive to permit smooth and efficient traffic flow. b. Be designed,constructed,operated and maintained so as to be harmonious in appearance with existing or intended character of the general vicinity and that such use will not change the essential character of the area in which it is proposed. Collection and temporary holding of yard waste pending transfer will be conducted on the eastern portion of the 400 Freel Drive site, away from observation of the general public from the street. A gate has been installed across the entrance to the 400 Freel Drive site and other measures undertaken to prevent after hours dumping. The 210 Freel Drive site will only be used on City of Ames designated "Free Days"for traffic to egress the 400 Freel Drive site. A gate will also be placed on the 400 Freel drive site as it intersects with 210 Freel Drive to prevent after hours dumping. Collected yard waste/brush/tree materials are being removed on a regular basis to Chamness Technology's Eddyville, Iowa Composting Facility and will be completely removed, weather conditions permitting, at the end of each season. c. Not be hazardous or disturbing to existing or future uses in the same general vicinity. Only yard waste, brush and trees will be collected/processed at the 400 Freel Drive Site. The 210 Freel Drive site will only be used on city designated "Free Days" to permit traffic to egress from the 400 Free[ Drive Site. The materials being collected at the 400 Freel Drive Site will be removed at the end of each collection season (weather permitting). Per our lease with the landowner, Chamness Technology will remove all collected materials upon termination of the lease. d. Be served adequately by essential public facilities and services such as highways,streets, police,fire protection,drainage structure, refuse disposal,water and sewage facilities, and/or schools. Neither the 400 Freel Drive or 210 Freel Drive sites will be developed to the point that additional infrastructure will be required or needed. e. Not create excessive additional requirements at public cost for public facilities and services. Neither site will be developed beyond existing infrastructure or need additional infrastructure to support planned operations. Per our contract with the City, we are required to implement dust control measures, in this case application of dust control chemicals in the fall and spring to reduce dust generated by traffic visiting the site. f. Not involve uses,activities, processes, materials,equipment or conditions of operation that will be detrimental to any person, property or general welfare by reason of excessive production of traffic, noise,smoke,fumes,glare,or odors. Five times per year(once in the April/May timeframe and four times in the late October to early December timeframe on city designated "Free Days") and only on Saturdays, will there be a large volume of additional traffic generated by visitors to these sites. This increased traffic flow will be coordinated with Ames PD and Public Works and managed by Chamness employees/volunteers to minimize impact. On each of these days, an estimated 700 to 1000 vehicles will visit the sites over the course of 8 hours, with most traffic in the morning. Internal traffic patterns have been developed to permit up to 40 vehicles on site at any given time with the average time on site under ten minutes. g. Be consistent with the intent and purpose of the Zone in which it is proposed to locate such use. Both Sites are located in an area zoned "General Industrial', with many of the nearby businesses in the salvage, recycling or waste management business. The intended use of these sites for the collection of yard waste, brush and trees for processing/transfer is consistent with the zoning criteria for"General Industrial'. The 400 Free[ Drive Site is currently operating as a Yard Waste Collection and transfer Site under a City of Ames approved Special Use Permit (#17-07) and the 210 Freel Drive site has been previously approved as a Yard Waste Collection Site. This application is submitted to add the use of 210 Freel Drive on City designated"Yard Waste Free Days"to improve traffic flow by allowing traffic to egress from 400 Freel Drive through 210 Freel Drive. Special Use Permit 017-77 requires that a follow-on permit be submitted for continued use of 400 Freel Drive after May 1, 2018. This enclosed application is also submitted to amend the current expiration date for Special Use Permit 077-17 to May 1, 2019, the end of Chamness Technology's current contract to operate a Yard Waste Collection Site for the City of Ames.
