IOWA GEOCODE NO. 05-27-105-060 DECISION & ORDER Emrah Simsek has submitted an application for a Special Home Occupation Permit. The applicant, operating as Chronox, LLC, purchases electronic equipment which is delivered to his home by parcel delivery. He repackages it, sells it and ships it to the buyer. The property is located at 3907 Berkshire Avenue and is zoned Residential Low Density (RL). The activity at this location will be conducted within the existing dwelling. No exterior changes are proposed. The applicant states that 600 square feet of the principal building will be used, out of a total area of the house of 2,738 square feet (22%), which is within the maximum (25%) area permitted for a special home occupation. The applicant proposes no signs. The applicant states that there will be no other employees. The applicant states that incoming shipments by standard UPS or FedEx truck will occur up to five times a week. Outgoing shipments will be picked up by similar parcel pickup and will occur less frequently, about once a month. No customers will arrive and no additional parking is required. Parcel delivery trucks typically park in the street. Berkshire Avenue is classified as a local street. No classes will be taught. There are no other home occupations at this location. Staff recommended approval. Neighbors within 200 feet were notified of the application and the hearing, and no objections were received. DECISION The Board considers the facts as detailed above, and the requirements for a Special Home Occupation Permit in Ames Municipal Code section 29.1304(3), and determines that the application meets the requirements, and that the Special Home Occupation Permit shall be granted. WHEREFORE, IT IS ORDERED that the applicant is GRANTED, section 29.1304(3) of the Ames Municipal Code, a Special Home Occupation Permit to operate an electronics sales business at the property located at 3907 Berkshire Avenue. Any person desiring to appeal this decision to a court of record may do so within 30 days after the filing of this decision.
