Thank you for providing the Iowa Historic Preservation Office(SHPO)with the opportunity to review this undertaking. We make the following comments and recommendations based on our review of this material, consultation of SHPO files, and in accordance with Section 106 of the National Historic Preservation Act of 1966 and its implementing regulations 36 CFR part 800 (revised, effective August 5,2004),as well as the requirements set forth in the Nationwide Programmatic Agreement(NPA)for FCC undertakings(effective March 7,2005)and the Nationwide Programmatic Agreement for the Collocation of Wireless Antennas. The submittal reports that there are no known archaeological sites or other types of historic properties in or adjacent to the project's Area of Potential Effects(APE)for direct effects. The viewshed survey identified no significant standing structures or other types of historic properties within the APE for visual effects. Therefore, considering the results of these studies,we are able to concur with your determination that No Historic Properties will be Affected by this undertaking. Be advised that the successful conclusion of consultation with the SHPO does not fulfill the agency's responsibility to consult with other parties that may have an interest in properties that may be affected by this project.Nor does it override the sovereign status of federally recognized American Indian Tribes in the Section 106 consultation process. If design changes involving undisturbed new rights-of-way or easements are made for this project, please forward additional information to our office for further comment along with the Agency Official's determination of effect. If project activities uncover any item(s)that might be of archaeological, historical,or architectural interest,or if important new archaeological, historical,or architectural data should be encountered in the project APE,the applicant should make reasonable efforts to avoid further impacts to the property until an assessment can be made by an individual meeting the Secretary of the Interior's professional qualifications standards(36 CFR Part 61). We have made these comments and recommendations according to our responsibility defined by Federal law pertaining to the Section 106 process. Should you have any additional comments or questions, please contact me at doug.jones@iowa.gov or at 515.281.4358. We provide the following response in accordance with Section 106 of the National Historic Preservation Act of 1966 (16 U.S.C.470 et seq.)and its implementing regulations 36 CFR Part 800(revised,effective August 5,2004). At this point we are unable to conclude our review for the following reasons. 1. The soils described in Appendix D are not consistent with what appears in Photograph 5. A buried horizon appears to present at the base of the Shovel test. 2. The National Register eligibility of 13SR199 has not been determined and is presently under review by our office and Federal Highway and Iowa DOT. Additional intensive fieldwork appears to be warranted to investigate deep site potential and determine if 13SR199 extends into the lease area. i Dan Higginbottom, Archaeologist STATE HISTORICAL SOCIETY OF IOWA Of CULTURAL AFFAIRS State Historic Preservation Office 600 East Locust Street Des Moines,Iowa 50319 2
