DECISION & ORDER
Devon Uric has filed an application for a Special Home Occupation to allow for a direct and
online sales business in the home at 1009 Clark Avenue. The property is zoned Residential
Medium Density, Single larnily Conservation Overlay (RM, O-Sf,C). The applicant appeared
and testified. City Planner Julie Gould represented the Department of Planning & Housing, and
submitted a written report to the Board.
The home is a two and a hall' -story house with a basement. The business would be located on the
main floor and occupy a total of 105 square feet of the 1,456 square feet of floor area in the
house, which is 7.2% of` the total floor area ol'the home, and less than the maximum 25%. This
area will be large enough to allow Im storage of inventory and a work space that includes a
table/desk and laptop computer. No modifications to the home arc being proposed for use by the
business. There are no set hours, as customer visits are not expected to be a daily occurrence and
visits will be light and intermittent. The applicant explains that there will be no other employees
and no signs. Delivery would be approximately twice weekly, via standard commercial delivery
services. The home has a detached garage and a driveway to Clark Avenue. The site will be able
to accommodate 4 off-street parking spaces for potential clients. There will be occasional client
visits to the site for demonstrations and gatherings. The applicant will be selling LuLaRoc
clothing. Notification of the application was sent to all property owners within 200 fleet of the
subject property and no objections to the application were received.
Staffrecommended approval of'the Special Use Permit.
DECISION
The Board considers the evidence in the record, including testimony, the staff report and
exhibits, and considers the requirements and standards for approval of'a Special Use Permit in
Arries Municipal Code Section 29.1304(2)(b) and (3), and finds that the application meets the
standards and shall be approved.
