DECISION & ORDER
The property at this address is a single-family detached home located in the "IZL" (Residential
Low Density) zoning district. The property IS Surrounded on the north by a single family home,
the east by I lunziker Drive, the South by 20"' Street, and the west by a single family home. The
Applicant has been operating a day care out of her home at this location for several years. She
was recently made aware of the need to obtain approval frorn the City for her (lay care. Her
operation is licensed by the Iowa Department of lurnan Services as a C I category, which allows
up to eight children of any age. The Applicant cares for eight children at her home. She
employs no other people on a regular basis, although her husband and daughter sometimes assist.
Child day care facilities are allowed in this zone and need either a Special Use Permit (S[,.Jll) or a
Special 1-forne Occupation (S140) permit. A Sf I0 permit limits the number ol'children to six
preschool and five school aged children. Since the Applicant serves eight children, seven pre-
school and one school aged, she would need to obtain a SUP.
Staff presented evidence that the Applicant met all the criteria for a Special Use Permit, finding

the application met all the general standards and residential zone standards. Staff proposed a
condition to limit enrollment to no more than eight children without further review of` the City to
ensure compatibility with the residential neighborhood and compliance with the State license.
The Applicant presented no evidence to the contrary.

The Board considers the standards applicable to Special Use permits from the provisions of the
zoning ordinance. (laving heard the evidence presented about this proposed facility, the Board
finds that it meets the general standards for a Special Use Permit in section 29.1503)(4)(a) and the
applicable residential zone standards in section 29.1503(4)(b). III light of the evidence presented
and the findings in the staff'report, the Board determines that granting the permit is appropriate.
ORDER
W11EREFORE, IT IS ORDERED that the applicant is GRANTED a Special Use Permit in an
RL, zoning district, sections 29.1503(4)(a) and (b), and (e) ofthe Ames Municipal Cocle, to allow
the operation of a child day care facility at the property located at 20031 llUnziker, in
conformance with the following condition:
That the day care facility be limited to no more than eight children of any conibination of
full-time, part-time, or school -age (the standard allowed as a Cl home registered by the
Department OffiUman Services).
Any person desiring to appeal this decision to a court of record may do so within 30 clays after
the filing of this decision.
