The property Is zoned ­N(... (Neighborhood Commercial) and is surrounded by high density residential to the north, low density residential to the east and south, and commercial to the west. The applicant is seeking to COrlStrUCt a new 1110110POIc cell tower on the property. The new tovvcr and associated equipment shelter will be located in a lcasearea along the northern hOUndary 01'thC Property with al'I access edSelnCln tlll'(,)L[()h the existing C01111nercial parking lot from 24'" Street. The required irilrili-i'min setback is 60 feet based on the overall height of 95 feet. The tower is approxinlately 205 feet from 24`I, Street, 232 feet from Grand Avenue, 170 f'ect From Jensen Avenue, and 65 feet 11-0111 the SOLIth property line of the apartments located north of the property, thus meeting all I-CCILlired minimum setbacks. All areas of' access to the leased site are paved in compliance With the rolling ordinance. The new tower will be an 85 foot tall monopole, 95 fect in height with the lightning) rod. The tower will be within a, 40 by 40 foot fenced C0111I)OL111d which will HICILIde in enclosed equipment shelter. The proposed equipment shelter provides security and screening for the equipment needed for the tower. Staff presented evidence that the application meets all the criteria of sections 29.1307 and 29.1503)(4). Stall' rioted recent state code amendments, specifically the new Cell 'Power SitillO Act, and advised that certain elements relating to the location of the cell tower COUld not be taken into consideration. The applicant provided no evidence to the contrary. DECISION The Board considers the standards applicable to special use permits from the provisions of the zoning ordinance.
