RESOLUTION NO. 22-147
RESOLUTION APPROVING VACATION OF PUBLIC UTILITY EASEMENT
AND WATER MAIN EASEMENT FOR 1915 PHILADELPHIA STREET
FOR THE CITY OF AMES, IOWA
WHEREAS,there is an existing 15 feet public utility and water main easements at the property
located at 1915 Philadelphia Street; and,
WHEREAS, the property owner made a request to vacate the 15 feet of the public utility and
water main easements; and,
WHEREAS,pursuant to Iowa Code Section 364.7,notice was given on March 8,2022, and a
public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of the public utility easement and establishing a public hearing date regarding the proposal has
been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The 15 feet of the existing public utility and water main easement across the following
described land is hereby vacated:
The East 10 feet of Lot 6,except the South 10 feet and except the North 10 feet thereof,the West
5 feet of Lot 5,except the South 10 feet and except the North 10 feet thereof,and a strip 10 feet in width
lying in said Lot 5 and being situated 5 feet on each side of the following centerline: Beginning at a
point on the west line of said Lot 5 which is 106. 72 feet North of the Southwest Corner thereof,thence
S89040'10"E, 25.00 feet, and there terminating, all being part of Walter Family Campus Subdivision,
City of Ames, Story County, Iowa.
ADOPTED THIS 22nd day of March, 2022.
