HomeMy WebLinkAboutA11 t i CITY OF Ames" Smart Choice Caring People Quality Programs Exceptional Service TO: Zoning Board of Adjustment FROM: Charlie Kuester, Planner DATE: August 5, 2016 SUBJECT: Extension request for Special Use Permit approved on June 24, 2015 and subsequently extended for 60 days on June 22, 2016 The Zoning Board of Adjustment approved a Special Use Permit for a proposed Verizon cell tower at 600 South Maple Avenue on June 24, 2015. The Board also approved a Conditional Use Permit in the Floodway on that same date. Ames Municipal Code, Section 29.1503 (5) states that Special Use Permits shall expire 12 months after the date of approval unless a building permit is issued AND actual construction begun. If the Special Use Permit expires, the applicant would need to submit a new application. The Board granted a 60-day extension at their meeting on June 22, 2016. This extension requires construction to commence before August 22, 2016. Verizon provided a written request on July 20, 2016 asking for an additional 60-day extension. Verizon is still awaiting federal regulatory approval and is requesting an additional 60-day extension. The delay in construction appears to be out of the hands of the applicant. There have been no changes in design specifications or local regulatory requirements that a new application for the same project would need to meet. Therefore, staff believes an additional 60-day extension would not harm the interests of the city or the neighborhood. Staff notes that additional extensions beyond October 22"a are discouraged without a verifiable timeframe for construction. 1 lm;hte inc. Maple Avenue. Last year Verizon received zoning approval and a building permit was subsequently issued. Due to delays in receiving all regulatory approvals,Verizon is unable to commence construction. Therefore, Verizon requested and received approval from the Zoning Board of Adjustment for a 60 day extension of the special use permit. The extension period ends on August 22,2016. Verizon continues to pursue issuance of the finding of no significant impact and plans to commence construction upon receipt of same. As previously mentioned, Verizon remains hopeful that the finding of no significant impact will issue before August 22, 2016. However, as a precaution against expiration, Verizon would like to request one more 60 day extension. Thank you for considering this request.
