HomeMy WebLinkAbout~Master - Special Home Occupation Permit to allow a massage therapy business at 619 8th Streeti DEC 302014 ZONING BOARD OF ADJUS IN THE MATTER OF THE APPLICATION OF VICTORIA KEINERT FOR A SPECIAL HOME OCCUPATION PERMIT, § 29.1304(3), AMES MUNICIPAL CODE, TO OPERATE A PROFESSIONAL MASSAGE THERAPY BUSINESS ON THE PROPERTY LOCATED AT 619 8T11 STREET FACTS CASE NO. 14-31 GEOCODE NO.09-02-300-170 DECISION & ORDER The property at this address is a two-story, single family home with a basement and with a separate accessory building/single-car garage near the alley in the rear. The property is located in a residential neighborhood in an "RM" (Residential Medium Density) "O-SFC" (Single Family Conservation Overlay) zoning district. The applicant is seeking a Special Home Occupation Permit to allow the operation of a professional massage therapy business at this location. The massage therapy business is proposed to be operated Monday through Friday from 9:00 a.m. to 6:00 p.m. one client at a time, by appointment only, and no more than seven appointments per day. The activity at this location will consist of professional massage therapy, which does not require any alterations to the premises. The proposed use will occupy approximately 144 square feet of the 2,119 square foot home, which is approximately 7% of the total floor area of the home and is less than the maximum code area of 25% permitted for a special home occupation. The homeowner is the only employee of the business. A sign no larger than one square foot is proposed, as permitted for a special home occupation. There is no off-street parking for clients. On -street parking is allowed on 81' Street and there is 140 feet without driveways in front of the applicant's property and two adjacent properties. It is likely that no more than one client vehicle at a time will be parked. Staff presented evidence that the criteria for a Special Home Occupation Permit as required in section 29.1304(3) have been met. DECISION The Board considers the standards applicable to Special Home Occupation Permits under the provisions of the zoning ordinance. Having heard the evidence presented about this proposed business, the Board finds that it meets the standards for the area to be used, signage and number of employees. Equipment, traffic and parking associated with outside employees are not involved in this business, and client and delivery traffic are in compliance with the standards of the ordinance and should not negatively impact the neighborhood. In light of the evidence presented and the findings in the staff report, the Board determines that granting the permit is appropriate. 01MER WHEREFORE, IT IS ORDERED that the applicant is granted a Special llorne Occupation Permit, section 29.1304(3) of the Ames MU11iCi])al Code, to allow operation of professional massage therapy bUSinCSS at the property located at 619 8"' Street. Any person desiring to appeal this decision to a court of record may do so within 30 days after the filing of this decision.
