Dear ZBA members,
My understanding is that Charlie will be bringing the information to you that you requested of staff at the last
Board meeting,regarding the 100-year flood plain and potential flooding effects,re:the application for a
Conditional Use Permit for an Alternate Method of Elevating a Residential Property Structure in the Floodway
Fringe at 1204 S.4th Street. (First item on the agenda).
I am not sure if all of you have ever been provided with the Rules of the ZBA,which were adopted by the Ames
City Council. I have attached a copy of the Rules to this e-mail.
Section IV,paragraph A(1)states: "The Board will endeavor to make a decision immediately following
presentation of evidence and arguments,but may take a matter under advisement and make a
decision at a later date. If a matter is taken under advisement,a decision thereon shall be made and
announced not later than the next regularly-scheduled session of the Board."
Although the Board may or may not have"taken the matter under advisement,"it did close the public hearing
last time(after the second meeting at which a public hearing was held). My reading of this rule is that the
Board should proceed to make a decision tonight,after receiving the information requested from staff,as the
rules indicate that the board should endeavor to make a decision immediately following presentation of
evidence and arguments. Any further deferral of the matter would be certainly violating the spirit,if not the
letter,of the rules.
