Dear Board members, I'd like to remind all of you of the quasi-judicial nature of the proceedings of the board. Your decisions need to be based on the evidence provided at the public hearing. It is important that you not have direct communication with the applicant, the neighbors, or other interested parties outside of the meeting. If any contact you, please inform them, politely, that they should bring any oral testimony to the meeting or to provide any written comments to City staff. It is also important that the board not have conversations about the issue among yourselves unless you are in the meeting. If you do have such contact,you will have to disclose that fact, as well as with whom and the substance of the discussion, at the board meeting. All board members need to have all the information. If this ex parte communication is extensive and you feel it has influenced where you stand on the issue,you may have to recuse yourself from deliberations and the vote. All this is important in order to assure the impartiality of the board and the transparency of its decision-making. City staff has asked that, if the applicant and the neighbors have additional information for the board, to provide it to staff and staff will ask Erin to distribute it or it will be brought to the meeting. If the board requests additional information, it should do so at the meeting, which may require deferral on the action if the requested information is not immediately available and is important to the decision.
