DECISION & ORDER
The property at this address is a two=story single family home. The property is located in a
residential neighborhood in an "FS-RL" (Suburban Residential Low Density) zoning district.
The applicant is seeking a Special Home Occupation Permit to allow the operation of a Family
Day Care IIome business at this location. The child care business is proposed to be operated
Monday through Friday from 7:30 a.m. to 5:30 p.m. The activity at this location will consist of
providing child care, which does not require any alterations to the premises. The applicant states
there will not be activities that will disrupt the neighbors. The proposed use will be conducted
on the first floor of the home. The applicant states that approximately 210 square feet of the first
floor will be used, out of a total area of the first floor of 1614 square feet (13%), which meets the
minimum code requirement of 35 square feet required for each child, exclusive of baths,
hallways, closets, kitchens and dining areas. The homeowner is the only employee of the
business. Visits to the home will be limited to dropping off and picking up children. No sign is
proposed. There are two parking spaces available in the driveway, in addition to the garage.
There are no other home occupations at this location. Staff presented evidence that the criteria
for a Special Home Occupation Permit as required in section 29.1304(3) have been met.
DECISION
The Board considers the standards applicable to Special Home Occupation Permits under the
provisions of the zoning ordinance. Having heard the evidence presented about this proposed
business, the Board finds that it meets the standards for the area to be used, signage and number
of employees. Equipment and the traffic and parking associated with outside employees are not
involved in this business, and client traffic is in compliance with the standards of the ordinance
and should not alter the normal residential character of the area. In light of the evidence
presented and the findings in the staff report, the Board determines that granting the permit is
appropriate.
WHEREFORE, IT IS ORDERED that the applicant is granted a Special I lorric Occupation
Permit, section 29.1304(3) of the Ames Municipal Code, to allow operation of' a Family Day
Care I lotne business at the property located at 124 1 lartl'ord Drive.
Any person desiring to appeal this decision to a court of" record may do so within 10 days after
the, filing of'this decision.
