Approval of the Flood Plain Variance by the Zoning Board of Adjustment in no way absolves the applicant from subsequently obtaining the necessary building permits or other permits from the City of Ames or from other applicable agencies. Signed by: Date: / 31 r� ropert Owner(s Print Nam (Note: No other signature may be substituted for the Property Owner's Signature.) 4 Application Form Last Updated: March 25,2013 Flood Plain Variance Supporting Information (This form must be filled out completely before your application will be accepted) The Zoning Board of Adjustment may authorize, in specific cases, such variances from the terms of the flood plain ordinance as will not be contrary to the public interest, where owing to special conditions a strict enforcement of the provisions of the ordinance will result in unnecessary hardship. In order to facilitate review of this application for a Flood Plain Variance, the applicant must address each of the "Standards" set forth in Section 9.7(3)(d) of the Municipal Code, which are listed below. (Note: The applicant's explanation of how the request meets each standard may be attached on a separate sheet if sufficient space is not provided.) 1. Variance Standards. The Zoning Board of Adjustment shall review each application for the purpose of determining that the variance standards are satisfied. Pursuant to the Municipal Code, a Flood Plain Variance shall be granted only if the following performance standards are satisfied: (a) No variance shall be granted for any development within the Floodway District which would result in any increase in the 100-year level. Consideration of the effects of any development on flood levels shall be based upon the assumption that an equal degree of development would be allowed for similarly situated lands. Explain how the request meets this standard. A no-rise certification has been provided based on flood level modeling of the proposed improvements. Modeling was completed using the soon to be effective College Creek preliminary model, as the current effective model is superseded by current, revised information. As the model is not yet effective, a variance is requested based on the preliminary model until such time that the model becomes effective. 5 Application Form Last Updated:March 25,2013 (b) Variances shall only be granted upon: (i) A showing of good and sufficient cause; (ii) A determination that failure to grant the variance would result in an unnecessary hardship to the applicant; and, (iii) A determination that the granting of the variance will not result in increased flood heights, additional threats to public safety, extraordinary public expense, create nuisances, or cause fraud on or victimization of the public. Explain how the request meets this standard. As the preliminary model is not yet effective, the model was used as it is the most recent current information. Not granting the variance would result in the School District having to wait 3 months until the preliminary model becomes effective or using the current effective model,which would result in greatly increased cost for the project. Granting the variance will not result in increased flood heights and is not anticipated to add additional threats to public safety, public expense, nuisances, or cause fraud or victimization of the public. (c) Variance shall only be granted upon a determination that the variance is the minimum necessary, considering the flood hazard to afford relief. Explain how the request meets this standard. The variance request is asking for acceptance of a no-rise based on the College Creek preliminary model, which is anticipated to become effective in October of 2014. 6 Application Form Last Updated:March 25,2013 (d) In cases where the variance involves a lower level of flood protection for buildings than what is ordinarily required by this ordinance, the applicant shall be notified in writing over the signature of the Zoning Administrator that: (i) The issuance of a variance will result in increased premium rates for flood insurance up to amounts as high as $25 for $100 of insurance coverage; and (ii) Such construction increases risks to life and property. Explain how the request meets this standard. It is not anticipated that the variance involves a lower level of flood protection. (e) All variances granted shall have the concurrence or approval of the Department of Natural Resources. Upon receipt of the Decision and Order from the Zoning Board of Adjustment, the applicant is responsible for submitting all applicable information for concurrence or approval from the Department of Natural Resources. No building permit or zoning permit will be issued until the City receives conformation of concurrence or approval from the Department of Natural Resources. The information has been forwarded to the Iowa Department of Natural Resources Flood Plains. 7 Application Form Last Updated:March 25,2013 Flood Plain Variance Site Plan Checklist The applicant shall submit a Site Plan, drawn to scale, that clearly shows the subject property for which the Conditional Use Permit is being sought. If a Major or Minor Site Development Plan was submitted as part of the development approval process for the subject property, then that Major or Minor Site Development Plan should also be submitted with the Conditional Use Permit application. The Site Plan shall include at a minimum the following information: ❑ Description of the land on which the proposed work is to be done (i.e., lot, block, tract, street address, or similar description) that will readily identify and locate the work to be done ❑ Identification of the use or occupancy for which the proposed work is intended ❑ The base flood elevation (BFE) ❑ Elevation (in relation to National Geodetic Vertical Datum NGVD29) of the lowest floor (including basement) of buildings or of the level to which a building is to be flood-proofed ❑ For buildings being improved or rebuilt, the estimated cost of improvement and the market value of the building prior to the improvements ❑ Such other information as the Administrator deems reasonably necessary for the purpose of this ordinance, including: ❑ Dimensioned property lines ❑ Abutting streets and alleys ❑ Location and size of all existing and proposed buildings and structures (include distances to all property lines and distances between buildings and structures) ❑ Required setbacks ❑ Driveways and parking areas, fully-dimensioned ❑ Other pertinent information necessary to fully understand the need for a Conditional Use Permit (e.g.: significant change in topography, location and size of mature trees, etc.) 8 Application Form Last Updated: March 25,2013 Permission to Place a "Zoning Action Pending" Sign on Private Property (This form must be filled out completely before your application will be accepted) Section 29.1500(2)(d)(iii) of the Zoning Ordinance, requires that notice shall be posted by the City on signs posted on the subject property. The owner of property at 3915 Mortensen Rd and 699 Dotson Dr hereby grants the City of Ames permission to place "Zoning Action Pending" signs on the property for the purpose of informing interested persons of the request for action by the City of Ames. I understand that the signs will be placed on the property several days prior to action on the request by the Planning and Zoning Commission, Zoning Board of Adjustment, or the City Council, and may remain on the property until the request has been approved or denied by the City.
