Section 29.1307(4) of the Zoning Ordinance states that a Special Use Permit is required for a cell site with antenna that is either not mounted on an existing tall structure or is more than 20 feet higher than the tall structure on which it is mounted. Such a cell site with antenna shall not be permitted except pursuant to a Special Use Permit issued by the Zoning Board of Adjustment in accordance with Sections 29.1503 and 29.1307. The Zoning Board of Adjustment cannot approve a Special Use Permit unless all of the "General Standards". the "Cell Site with Antenna"standards, and the "Commercial Zone Standards" are met, In order to facilitate review of this application for a Special Use Permit, the applicant must address each of the "General Standards"set forth in Section 29.1503, the standards for a "Cell Site with Antenna" set forth in Section 29.1307(7), and the "Commercial Zone Standards"set forth in Section 29.1503(4)(c) of the Zoning Ordinance. (Note: The applicant's explanation of how the request meets each standard may be attached on a separate sheet if sufficient space is not provided.) 1. General Standards. The Planning and Zoning Commission and the Zoning Board of Adjustment shall review each application for the purpose of determining that each proposed use meets the following standards, set forth in 29.1503(4)(a), and in addition, shall find adequate evidence that each use in its proposed location will: (a) Be harmonious with and in accordance with the general principles and proposals of the Land Use Policy Plan (LUPP). Explain how the request meets this standard. The Future Land Use Map of the LUPP designates this area as a commercial node. Provision of telecommunication services from an existing structure is consistent with this designation. 4 Application Form Last Updated: March 25, 2013 (b) Be designed, constructed, operated, and maintained so as to be harmonious in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the area in which it is proposed. Explain how the request meets this standard. The site is currently used as a wireless telecommunications site. The proposed co-location of Wireless' equipment will eliminate the need for Wireless to construct a new tower in the immediate vicinty. (c) Not be hazardous or disturbing to existing or future uses in the same general vicinity. Explain how the request meets this standard. The proposed us and facilities will have no adverse off-site impacts. There will be no additional lighting at the site The equipment creates no more noise than a standard residential air conditioning unit The facility will have minimal traffic as it is unmanned and is typically visited only once per month upon completion of construction. The facility will create no smoke, odor, or vibration. (d) Be served adequately by essential public facilities and services such as highways, streets, police, fire protection, drainage structure, refuse disposal, water and sewage facilities, and/or schools. Explain how the request meets this standard. There are adequate electricity and fiber optic services in the immediate vicinity to serve the facility. No other utility services are required. The facility will have negligible impacts on traffic as it is typically visited once per month after construction is complete. 5 Application Form Last Updated: March 25, 2013 (e) Not create excessive additional requirements at public cost for public facilities and services. Explain how the request meets this standard. As noted earlier,the facility will not create any utility or traffic impacts beyond that which can be served by the existing infrastructure in place As a passive facility, it will not impact other public services such as parks schools etc., although it will generate tax dollars to fund those services. (f) Not involve uses, activities, processes, materials, equipment, or conditions of operation that will be detrimental to any person, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare, or odors. Explain how the request meets this standard. As noted earlier,the facility will not impact traffic or create any noise smoke,fumes, glare, or odors. (g) Be consistent with the intent and purpose of the Zone in which it is proposed to locate such use. Explain how the request meets this standard. The property is zoned"RH" Residential High Density which is intended to accommodate -hi h density residential areas adjacent to commercial and employment centers. The proposed facility is intended to serve the high demand resulting from the residents in the area. The primary coverage area for the proposed facility is within one-half to one mile of the facility. 6 Application Form Last Updated: March 25, 2013 2. Standards for a Cell Site with Antenna: The Planning and Zoning Commission and Zoning Board of Adjustment shall review each application for the purpose of determining that the following standards, set forth in 29.1307(7), which are listed below, have been met, in addition to the "General Standards"and the "Commercial Zone Standards".- (a) Necessity. The wireless communications company shall demonstrate, using technological evidence, that the antenna must be located where it is proposed in order to satisfy the antenna's function in the company's grid system. Explain how the request meets this standard. Currently,there is a large area surrounding the proposed site without service. The proposed site will fill that gap and connect with existing sites See attached coverage plots. (b) Co-location Effort. If the wireless communications company proposes to build a tower (as opposed to mounting the antenna on an existing tall structure), it shall demonstrate that it contacted the owners of tall structures within a one-quarter- mile radius of the site proposed, asked for permission to install the antenna on those tall structures, and was denied for reasons other than failure to agree on compensation. The Zoning Board of Adjustment may deny the permit if it concludes that the applicant has not made a good faith effort to mount the antenna on an existing tall structure. Explain how the request meets this standard. Not applicable as the facility is a co location on an existing tall structure. (c) Antenna Height. The applicant shall demonstrate, to the reasonable satisfaction of the Zoning Board of Adjustment, that the antenna is the minimum height required to function satisfactorily. No antenna that is taller than this minimum height shall be approved. Explain how the request meets this standard. As evidenced by the attached coverage plots the proposed height does not create redundant coverage and is the minimal height necessary. Additional height would be beneficial but is not available on this structure. 7 Application Form Last Updated: March 25, 2013 (d) Setbacks from Base of Antenna Support Structure. The minimum distance between the base of the support or any guy anchors and any property line shall be the largest of the following: (i) 50% of antenna height; (ii) The minimum setback in the underlying Zone; or (iii) 60 feet. Explain how the request meets this standard. The proposed facility is an existing structure. If it does not meet one of the referenced setbacks, it would be grandfathered in. (e) Antenna Support Structure Safety. The applicant shall demonstrate, to the reasonable satisfaction of the Zoning Board of Adjustment, that the proposed antenna and support structure are safe and the surrounding areas will not be negatively affected by support structure failure, falling ice or other debris, or radio frequency interface. All support structures shall be fitted with anti-climbing devices, as approved by the manufacturers. Explain how the request meets this standard. The facility will meet the applicable structural standards see attached report by Semaan Engineering Solutions and dated February 18 2014. The surrounding areas will not be negatively affected falling ice or other debris due to the setbacks and the fact that the antennas will be flush mounted to the pole The facility will operate within the parameters of its license issued by the FCC which regulates radio frequency interference. (f) Fencing. An opaque fence constructed of wood or masonry material, or other substantial material, that is consistent with the existing structures on the proposed site and approved by the Zoning Board of Adjustment, shall be installed around the antenna support structure and other equipment unless the antenna is mounted on an existing structure. Explain how the request meets this standard. The compound is currently enclosed with an opaque fence. 8 Application Form Last Updated: March 25, 2013 (g) Co-location. In order to reduce the number of antenna support structures needed in the community in the future, the proposed support structure shall be required to accommodate other users, including other wireless communications companies and local police,fire, and ambulance companies. Explain how the request meets this standard. Not applicable as this is a request to co-locate on an existing support structure. (h) FCC License. The wireless communications company shall provide proof that it is licensed by the Federal Communications Commission. Explain how the request meets this standard. See attached FCC License. (i) Required Parking. If the cell site is fully automated, adequate parking shall be required for maintenance workers. If the site is not automated, the number of required parking spaces shall equal the number of people on the largest shift. Explain how the request meets this standard. The facility is typically visited only once per month. There is adequate parking on-site to accommodate that demand. 9 Application Form Last Updated: March 25, 2013 Q) Painting. Antenna support structures should be painted in such a manner as to reduce the visual impact and create a harmonious appearance with its surroundings. Explain how the request meets this standard. The exterior color of the antenna support structure will not change. (k) Site Plan. A full site plan shall be required for all cell sites, showing the antenna, antenna support structure, building,fencing, buffering, and access. Explain how the request meets this standard. See attached drawings. (1) Air Safety. Support structures 200 feet in height or taller, or those near airports, shall meet all Federal Aviation Administration regulations. Explain how the request meets this standard. The proposed antennas will not exceed the height of the existing tower. Therefore, there will be no impact on compliance with FAA regulations. 10 Application Form Last Updated: March 25, 2013 3. Commercial Zone Standards. The Planning and Zoning Commission and the Zoning Board of Adjustment shall review each application for the purpose of determining that each proposed use in a Commercial Zone meets the "Commercial Zone Standards", set forth in 29.1503(4)(b), which are listed below, in addition to the "General Standards" and the standards for a "Cell Site with Antenna"and shall find adequate evidence that each use in its proposed location will: (a) Be compatible with the potential commercial development and use of property planned to occur in the area. Explain how the request meets this standard. The existing structure is established as a communications facility. The proposed antennas will not exceed the height of the current antennas. The ground equipment will be located within the existing opaque fence screening it from offsite. The antennas will be flush-mounted to the pole, minimizing their visibility but allowing the pole to accommodate the antennas as there is no more room inside the pole The only alternative is to build a new tower in the area. (b) Represent the sufficiently desirable need for the entire community that the loss of commercial land is justifiable in relation to the benefit. Explain how the request meets this standard. The proposal will not result in the loss of commercial land as no new ground will be used. The community will benefit through the enhanced communication services provided by the proposed facility. (c) Be consistent with all other applicable standards in the zone. Explain how the request meets this standard. The proposed facility is a listed use in the district and meets all development standards including bulk requirements and signage standards. 11 Application Form Last Updated: March 25, 2013 Cell Site with Antenna Special Use Permit Site Development Plan Checklist for a Site in a Commercial Zone (This form must be filled out completely before your application will be accepted.) The applicant shall provide seven (7) copies of a Site Development Plan, which includes the information described below, as set forth in Section 29.1502 of the Zoning Ordinance. ❑ Seven (7) copies of a Site Development Plan, drawn to scale on a sheet not to exceed 24" x 36", and one (1) reduced copy no larger than 11"x 17". ❑ The Site Development Plan must be prepared by a Civil Engineer, a Land Surveyor, a Landscape Architect, or an Architect. The site plan must be certified as "substantially correct" by a Professional Engineer, a Land Surveyor, a Landscape Architect, or an Architect, licensed by the State of Iowa, showing the following information as of the date of the application. Note: With approval by City staff prior to submitting the Site Development Plan, it may be possible to exclude some of the following items from the Site Development Plan. Please place a check mark in the box in front of each item that is included as part of the application materials submitted for approval ❑ Name(s) and address(es) of the applicant(s). ❑ Name(s) and address(es) of the owner(s) of record of the property. ❑ Name and address of the person or firm preparing the site plan. ❑ Property address(es). ❑ Date of preparation. ❑ North Arrow. ❑ Scale: The scale shall not be less than 1"=10', and no greater than 1"=60% unless an alternate scale is approved by the Director of the Department of Planning and Housing. ❑ Legal Description. ❑ Dimensions of the present lot and lot area, to the nearest tenth of a foot. 12 Application Form Last Updated: March 25, 2013 ❑ Size and location of all existing and proposed buildings, additions, structures, and uses, including: ❑ Setback distance to property lines; ❑ Exact exterior dimensions of each building; ❑ Location of entrances; ❑ Number of dwelling units; and, ❑ Square footage of each type of use. ❑ Zoning designation of the property. ❑ Proposed use of the property in sufficient detail to determine code compliance. ❑ Existing and proposed location and size of sanitary sewer mains and service lines, or septic tank and leaching field. ❑ Existing and proposed location and size of water mains, service lines and hydrants, and/or water well. ❑ Existing and proposed location and size of electrical service (electrical riser diagram) and the location of high-pressure gas lines, high tension transmission lines, and telephone lines. ❑ Existing and proposed location and size of storm drainage facilities on the property and adjacent to the property. ❑ Location, grade, and dimensions of all existing paved surfaces and of all abutting streets. ❑ Existing and proposed location and dimensions of parking areas, individual parking spaces and drive aisles, driveways, curb cuts, easements and rights-of-way, walkways, transit stops, bicycle parking areas, loading areas, dividers, curbs, islands, and other parking and drive improvements. If the project is located along U.S. Highway 69, access to U.S. 69 shall be reviewed by the I.D.0.T. and a meeting shall be held that includes I.D.O.T. staff, the City traffic engineer, other appropriate City staff, the developer, and the developer's plan preparer to agree on access prior to the submittal of the site plan. ❑ Existing and proposed contours at 2-foot intervals, based on City datum, when an application pertains to any new permanent detached building or structure (principal or accessory). ❑ Location of existing and proposed outdoor trash and dumpster areas and methods for screening such areas. ❑ Location and type of all existing and proposed signs. 13 Application Form Last Updated: March 25, 2013 ❑ Evidence that the proposed work or activity will comply with the Outdoor Lighting Code, set forth in Section 29.411 of the Zoning Ordinance Specifically, the application shall include: ❑ Plans indicating the location on the premises, and the type of illuminating devices, fixtures, lamps, supports, reflectors, and other devices; ❑ A detailed description of the illuminating devices, fixtures, lamps, supports, reflectors, and other devices. The description shall include manufacturer's catalog cuts and drawings, including sections when requested; and, ❑ Photometric data, such as that furnished by manufacturers, showing the angle of cut off or light emissions. ❑ Location of waterbodies, watercourses, swamps and flood-prone areas with delineated channel encroachment lines, wetland boundary lines, 100-year flood plain boundary line, and floodway boundary line. ❑ When an application is located in a flood-prone area include existing and proposed site grades, contours and elevations, base flood elevation data, top-of-foundation elevations, finished floor elevations, and any proposed watercourse relocation. ❑ When an application for development involves 0.5 acres, or more, of cumulative disturbed area(s), a Sediment Erosion Control Plan shall be submitted. However, such a Plan may be required for applications with disturbed land of less than 0.5 acres, if deemed necessary by the Planning Director. ❑ Location of natural features including: existing trees, rock outcrops, and landslide areas. ❑ Storm water management plan, including storm water calculations supporting the design. Such plan shall show grades and/or elevations, direction of surface flow, detention and/or retention areas, outlet control structures, and devices. ❑ A landscape plan showing: ❑ The location of plants. ❑ A plant list that includes: ❑ The plant species; ❑ The quantity of each type of plant; and, ❑ The size of each plant at the time of planting. ❑ The location of fences and walls. ❑ Traffic impact studies, soil tests, utility capacity analysis, and other similar information if deemed necessary by the Department of Planning and Housing to determine the feasibility of the proposed development. 14 A' Application Form Last Updated: March 25, 2013 Cell Site with Antenna Special Use Permit for a Site in a Commercial Zone Permission to Place a "Zoning Action Pending" Sign on Private Property (This form must be filled out completely before your application will be accepted.) Section 29.1500(2)(d)(iii) of the Zoning Ordinance, requires that notice shall be posted by the City on signs posted on the subject property. One sign shall be posted for each public street frontage. Required signs shall be posted along the perimeter of the subject property in locations that are highly visible from adjacent public streets not less than seven (7) days prior to the meeting or hearing, unless otherwise prescribed by statute.
