DECISION & ORDER
The property at this address is a single story, single farmly detached home with a two car
attached gat -age. The property is located in a residential neighborhood in an "RI," (Residential
Low Density) zoning district. The applicant is seeking a Special I Ionic Occupation Permit to
allow the operation of a prolessional massage therapy business at this location. The massage
therapy business is proposed to be operated Monday through f,riday from 1:00 p.m. to 7:00 p.m.
and Saturday from 9:00 a.m. to 5:00 p.m., by appointment only. The activity at this location will
consist of'professional massage therapy, which does not require any alterations to the premises.
The proposed use will be conducted on the first floor of the home. The applicant proposes to use
473 square feet of the house Out of a total area of 2,582 square feet, or 18.3%, which is U1`1dCr the
maximum code area of 250/0 permitted for a special home Occupation. A sign of'one square toot
is proposed, as permitted for a special 1101TIC Occupation. The homeowner is the only employee
of the business. Visits to the ]ionic will be limited to appointment only, but will not exceed four
(4) per day. A future sign is proposed, no larger than one square foot. There are a total of' six
off-street parking spaces: 1`61,11- in the driveway and two in the garage. There are no other home.
Occupations at this location. Staff presented evidence that the criteria for a Special I Ionic
Occupation Permit as required in section 29.1304(3) have been met.
DECISION
The Board considers the standards applicable to Special lJoirie Occupation Permits under the
provisions of" the zoning ordinance. Having heard the evidence presented about this proposed
business, the Board finds that it meets the standards t'(,)r the area to be used, signage, and number
of employees. FqUipment and the traffic and parking associated with outside employees are not
involved in this business, and client and delivery traffic are in compliance with the standards of
the ordinance and should not negatively impact the neighborhood. In light of the evidence
presented and the findings in the staff report, the Board determines that granting the permit is
appropriate.
ORDER
WHEREFORE, IT IS ORDERED that the applicant is granted a Special Horne Occupation
Permit, section 29.1304(31) of the Ames Municipal Code, to allow operation of a prol'essional
massage therapy business at the property located at 3206.Joy Circle.
Any person desiring to appeal this decision to a court of'record may do so within 30 days after
the tiling of this decision.
