HomeMy WebLinkAbout~Master - Setting Date of Public Hearing for Proposed Vacation of Pedestrian Easement at 4901 Waller Street (Lot 4, Longview Subdivision, 2nd Addition) DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Diane Voss,Ames City Clerk,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5105 Return to:Ames City Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 21-485 RESOLUTION SETTING DATE OF PUBLIC HEARING FOR PROPOSED VACATION OF PEDESTRIAN EASEMENT AT 4901 WALLER STREET (LOT 4, LONGVIEW SUBDIVISION, 2ND ADDITION) FOR THE CITY OF AMES,IOWA WHEREAS,the owner of 4901 Waller Street is David Hohbach,and he had requested that an existing pedestrian easement located along the eastern ten feet of his property be vacated by the City of Ames; and, WHEREAS, he is proposing to pave a drive expansion to the east side of his attached garage that encroaches into the existing pedestrian easement; and, WHEREAS, the easement was first established as part of the approval of the Final Plat for Longview Subdivision, 2nd Addition, in October 2003; and, WHEREAS, the purpose of the easement was to provide access from the properties along Waller Street to the future Edwards Elementary School at 820 Miller Avenue; and, WHEREAS, the pedestrian easement has not been paved or used as an access to Edwards Elementary School since it was first established by the Final Plat. WHEREAS,pursuant to Iowa Code section 364.7,it is necessary to provide notice of and hold a public hearing regarding the proposal of the City to dispose of its interest in this real property; and, WHEREAS, following notice and public hearing, the City will determine if this proposal is appropriate. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA, THAT: 1. Pursuant to Iowa Code section 364.7, publication of notice regarding the proposed vacation of a pedestrian easement and establishing a public hearing date regarding the proposal is required. 2. The public hearing regarding the proposal to consider vacation of the City's interest in a pedestrian easement at 4901 Waller Street shall be held on September 28, 2021, at 6:00 p.m. 3. The City Clerk is hereby directed to provide notice of the public hearing as required by Iowa Code section 362.3. ADOPTED THIS 141''day of September, 2021. Diane . Voss, City Clerk John A.
