N O < :x 11 p :x i Oo:= ;x O n y AGREEMENT ENCROACHMENT PERMIT (vehicle Parking Area serving 2121 Sunset Drive along Gable Lane) It is agreed between the owners and persons in possession and control of the property at 2121 Sunset Drive, Ames, Iowa (hereinafter called Owners) and the City of Ames, Iowa, that: 1. With respect to a hard surfaced vehicle storage area over the public right of -,y alon5 Cable Lane at i.he 'rear of 2121 Sunset Drive, for which an en- croachment permit under Section 22.3 of the Municipal Code of Ames, 1980, may be issued, the said Owners do hereby agree to conform to the design, location limits, plans, and specifications as approved by the Municipal Engineer, and to indemnify and hold harmless the City of Ames, its officers and employees, against any loss or liability whatsoever, including at- torneys' fees, pertaining to any and all claims whatsoever made by any and all persons whomsoever, resulting from or arising out of the location, main- tenance and utilization of said vehicle storage area. 2. The Owners agree to maintain in effect, at all times the aforesaid vehicle storage area located over the city parking, public liability insurance in an amount of not less than $500,000 under which the City of Ames, its officers and employees shall be named as insured parties. Owners shall issue an in- surance ce.:cificare evidencing such coverage to the City ui nvue.� prior to autorization of the encroachment permit. 3. It is expressly understood and agreed that nothing herein contained shall be deemed a waiver or exemption from any ordinances or amendments thereto en- acted by the City of Ames; and, that the City may require the Owners, after notice and an opportunity for a hearing, to remove said vehicle storage area and discontinue its use for any legitimate reason. 4. This Covenant and Agreement shall run with the land and be binding upon the successors and assignees of the parties hereto.
